Timeline

Hi,

My Visa in the UK will be expiring soon and i already have a fiancee visa application with the US embassy in London. All i am waiting for is an invitation for visa interview at the US embassy since the petition has been approved by the US consulate and i already returned all the necessary documents and passed the medical examination. Now, i am scared my UK visa will expire before i get an invitation for visa interview from the London US embassy. Can i remain in the UK while waiting for the interview date?

Also, will my stay in the UK after my visa expires affect my US K-1 application? My fiance spoke to the USCIS and she was told they do not consider that when deciding a visa approval.

Exactly where are you in the process?

Exactly when does your UK visa expire? What sort of visa is it?

What country are you from?

Do you need to stay in the UK for work until your visa expires, or can you return to your home country very soon?

It's worth pointing out this whole forum is about US immigration, not UK visas, so there isn't much expertise. However, I don't see why UK Border Agency would extend your stay only so you can have an interview to move to the US, given that you could have done that in your home country. I'd imagine you'd need another reason for the visa extension. I'd guess your best, or even only, option is to return to your home country, and ask for the K-1 interview to be transferred there.

While previous illegal stays in other countries are not taken into account for the US visa you are applying for, you can only interview in a country's US embassy if you are there legally. So if you are an overstay in the UK by the time your US visa interview at the US embassy in London comes up, they will not interview you. You can have your case transfered to your home country if necessary.

I am aware of another person in the OP's situation whose UK visa expired prior to the interview. Female from an African country (i think) who went home and returned as a tourist to the interview. Arrangements were made, but I can't remember details. I had the details in a seriees of PMs and will look. I have to delete when the Pm box gets too full so may no longer have it.

Thanks a million for the responses everyone. My Visa expires on the 30th of this month and i am Nigerian. Sent my forms to the US embassy last week and had my medicals the week before. I'm sure the result of the medical is at the US embassy now. Rang the London US embassy some days ago to find out if my case could be transferred to the Lagos US embassy and i was told to ring the Lagos US embassy. Rang the Lagos US embassy and i was told to contact the US embassy in London. Now, everything seems so confusing.

Is it possible to transfer an application from one US embassy to another?

I've been through all my private messages and no longer have the one I wanted. The woman was a student and I was thinking Nigeria also. So I don't know how a Nigerian gets into the UK as a tourist. you probably know if that is possible. She finished her school. I know she went home before her student visa expired. Then she returned to England as a tourist, stayed with a friend or relative, interviewed in London, got her visa with no delay for additional processing.

You can have everything transferred but no telling how long that would take. You have to formally request it to Lagos, who in turn has to request the file from London. Not an easy option.

Since you are so close, call the embassy. Insist that you need to email a consulate official so they will give you the code. Keep insisting until they do. Politely ask over and over again. Then write the email to somebody that can do something about it. Tell them your story. Tell them the dates things were sent to them. Tell them you can come on one day's notice to an interview. Tell them you are x number of days invested in the whole K1 process and you really would like to be able to finish it with their help. Include your email and phone number.

Or do the tourist visa thing if possible. She had correspondence from the embassy that they would interview her in London so the border people knew why she needed to enter the UK for a short time.
