Getting married in Ecuador.

I am a USA citizen and Ecuadorian citizen and I have been dating a girl from Ecuador for the past 2 years, I have been back and fort.

I was wondering what do I need to do? Do I just go to Ecuador and married her? Do I married her as USA citizen or Ecuadorian citizen?

Do I need any documents from over here? I mean, I don't want to get there and realize we can't do it because I forgot some paper work.

I am totally lost and I figured I would ask here in case someone has done it. My last resource is a lawyer.

So, do I just go and married her? Just like that? What do I know to bring with me?

Ps" I am single, never married and one I have one daughter who is 2 yrs old who lives with her mom

11/05/2012 - NOA1 (email/text)
11/08/2012 - NOA1 (paper)
05/10/2013 - NOA2 (paper) for some reason, they didn't text me this time.
05/17/2013 - NVC received package.
05/24/2013 - NVC Sent package to Ecuador embassy (I called and they told me that)
05/28/2013 - Received mail from NVC notifying they have send my package to Ecuador.
05/31/2013 - Ecuador Consulate mail package to my fiancée.(I've already scheduled the interview before this)
07/15/2013 - Visa approved!
11/30/2013 - POE (smooth process, she was done in 1 hr)
12/21/2013 - We got married!
12/24/2013 - Applied for SSN

04/03/2014 - Received NOA for all 3
04/08/2014 - Received appointment for Biometrics
04/30/2014 - Received RFE (need proof of income)
05/06/2014 - Did Biometrics appointment
05/07/2014 - Sent RFE
06/14/2014 - Received EAD/AP combo card
07/10/2014 - Notice of Potential Interview Waiver Case

02/23/2015 - Opened a Case Inquiry "Outside Normal Processing Time"

03/09/2015 - USCIS responded with a letter, and pretty much said "keep waiting, we'll get to you"

03/24/2015 - "Card was ordered to be produced"

04/03/2015 - Greencard in hand!

I would check out the differences between spouse visa & fiance visa. From what I understand, the spouse visa takes a few more months on average, but ends up costing less overall & lets you bypass some red-tape. The VJ community is great. They've helped me a ton. Good luck.

2012/05/03 - Started "Dating"
2012/06/27-07/16 - Met in Haiti/got engaged
2012/08/20 - I-129F Sent
2012/08/28-09/05 - Second trip to Haiti
2012/08/28 - I-129F NOA1
2012/08/29 - Check Cashed
2012/08/31 - NOA1 Hard Copy Received
2012/09/05 - NOA2 (I-129F)
2012/09/10 - Emailed U.S. Embassy in Haiti for Packet 3.
2012/09/10 - NVC Received
2012/09/10 - NOA2 Hard-Copy
2012/09/11 - Called NVC to check status, told fiance's DOB is wrong, but it's right on both application forms. They said send birth cert & passport.
2012/09/13 - Submitted DS-156 online & printed copies (& emailed to both of us).
2012/09/14 - Emailed scanned copies of original application, birth cert & passport to NVC.
2012/09/14 - Called & insisted they fix THEIR mistake. Message forwarded to supervisor. Got an email within 30 minutes; fixed! Called & confirmed.
2012/09/19 - Still in AP (Administrative/Additional Processing)... waiting...
2012/09/25 - Left NVC
2013/01/08/18 - Third trip to Haiti
2013/01/17 - K1 Visa Denied (he had been given a fake death certificate for his first wife who was killed in the 2010 earthquake)
2013/03/05-20 - Fourth trip to Haiti
2013/03/14 - Got Married in Port au Prince

2013/08/11-22 - Fifth trip to Haiti

2014/01/26-02/12 - Sixth trip to Haiti

2014/03/12-15 - Seventh trip to Haiti

If you want to get married in Ecuador, do it as an Ecuadorian Citizen as its a lot easier and less paperwork. Here is the info from the Registro Civil website:

Matrimonio de ecuatorianos solteros mayores de edad

Requisitos

1. Cédula de Ciudadanía de los contrayentes (Original y Copia legible).

2. Certificado de Votación de los contrayentes (Original y Copia legible).

3. La presencia de dos testigos hábiles, quienes deben presentar cédula de ciudadanía o identificación y certificado de votación ( Original y Copia legible).

Nota: Pudiendo a petición de parte haber otros testigos.

4. Si los contrayentes tienen hijos menores de edad en común presentar Partida de Nacimiento.

5. Si tienen hijos menores de edad bajo su patria potestad, deben presentar Curaduria Especial Protocolizada.

6. Si estuviere administrando bienes de los menores de edad que se encuentran bajo su patria potestad presentar Inventario Solemne de Bienes, trámite que debe ser practicado ante un Juez de lo Civil.

7. En caso de no ejercer la patria potestad del menor presentar Declaración Juramentada de no tener la patria potestad, trámite que se realizara en una Notaria.

Since you are a dual citizen, you can just go to Ecuador and get married without any problem. Foreigners who are not Ecuadorian Citizens have to wait 75 days before getting married, but that won't apply in your case.

If you want to bring your wife to the US after you get married, you will need to file the CR-1 visa for her.

Thank for all the info. I have heard the spouse visa a d fiancée visa.

I heard fiancée visa is easier, faster and cheaper, could any of you guys with experience tell me, how easier, how cheaper and how quick is than the spouce visa?

I am also thinking on hiring a lawyer, how much Gould that run me for from the time I hire him to the time I get my sweatheart here, an estimate would be good, no exact number is okay.

Actually, the OP hasn't come right out and said that he wants to bring his fiancee/wife to the U.S., but he's asking about a comparison between the K-1 & CR-1 visas.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
