On occasion an immigration attorney may encounter a foreign person who has had a sex change operation and who thereafter seeks an immigration benefit based on marriage to a U.S. spouse. I have encountered two such situations in my career, and found that USCIS was consistent in its adjudication of both. At least in my jurisdiction, USCIS takes the position that the sex of the foreign spouse is that which is stated on the person�s passport, regardless of person�s new physiological characteristics. In both cases, the sex changes involved male to female operations. In the first, the marriage was to a man; in the second the marriage was to a woman. Surprisingly, only in the second instance, where the woman married another woman, did USCIS recognize the union and grant immigration benefits. The marriage was lawful because the woman�s identity documentation still classified her as male.

American individuals who change genders typically get reclassified by petitioning the countries in which they were born to change the gender on their birth certificates. Only after legally changing their gender can they go forward and marry individuals of the opposite sex. Foreign individuals could similarly petition their home countries to get the gender on their passports switched, although certain countries would not be likely to cooperate. It would be interesting to see whether a foreign transsexual could obtain a U.S. post-operative court order legally reclassifying his or her gender, and whether USCIS would reconsider its position of recognizing only the gender listed on the passport.

Whooooa, slow down. I really don't think this is much of an issue outside of matako's bigoted little mind. Has a transgendered person ever even been petitioned for a US visa? Isn't marriage a requirement? Can a transgendered person (born male and SRS surgery) marry a man in the US? If not then I don't see how a marriage outside the US would be recognized therefor no fiancee/spousal visa would be possible.

Matako, him/herself is our very own VJ transgender as they started out female and then later changed to male. Ask Kitkat for details.

Ok so the male is now a female and even has a vag!na, there is no more male-like hair, there are boobies, etc.

Visa issues aside, even if it happened here...like a guy meets a guy who is now a girl.....how would a guy even notice?

And do they get pms??

I wish i could post a picture of that surgery where women turn to a guy.... i got the forward mail of that quite often... I cant realy explain though.. but it looks like a little one and they use critoris to be the head so... :unsure:

Well, I didn't know the answer to that one either, so I took a look on Google and found this on Wikipedia about the subject. Granted, Wikipedia can USUALLY be written and edited by anyone (there are instances where entries are locked and/or made so only certain individuals can write), but assuming the information is accurate, it does explain in detail the process of a female becoming a male.

Most websites I found while searching don't talk a lot about female-to-male SRS; usually it's the other way around.

The reasons for most American men going overseas to find woman is that A) They are generally prettier than American woman because they are not fake, or drama queen like. B) Because American men desire TRADITIONAL woman. C) Most woman in other countries other than the US actually appreciate the simple things in life.

8/10 of my friends Married a woman overseas for this reason. Maybe I just have friends that are concentrated to feel this way in one particular area. I did use the word MOST though. Maybe I should have use the word some?

Um, I have not seen any evidence anywhere that suggests that INS denies visas for sex change,transgender people. But all I have to say is.... funny yet uncomfortably situation for the consulate officers :lol:

This whole sex change things should be talked over in the beginning of relationships of course, but some people think they donnot have tell anyone about it. That is why I think the meetings are very important....

But I am curious to know, after applying for the visa, at the medical exam...does this not come out? And wouldnt a sex change op leave a paper trail...like you were born a man on your birth cert and suddenly you appear at the interview voila a women?! :wacko: And even these ppl go throu the courts to obtain some documents saying they changed their sex....still a paper trail no?!

I feel really sorry for people who have fell into this type of trap... thinking that their lover was something then after all this finding out that they are not. I mean I personally find sex changes ops wrong, BUUUUUT everyone does have right/ablity to do what they want with their bodies..... but still to lie to someone on this grande scale is SOOOOOOOOOOOO wrong . I think their should be laws. Like they have AIDS laws too in many places...no?!

Warning to transgenderd person: Your past cannot and should not deleted. Live your life the way you want, it is your right but be clear with your loved ones. Not right to lie. Better to tell up front, to avoid any crimes of passion (ie murder) being done to you...once your SO would find out.

First off, your picture is kinda creepy. Is that you and your SO or is that a fake pic?

Second, if I am reading your post correctly... what does it have to do with transgendered people?

But anyway third, thanks for your opinion. Could apply to some people I guess.

And fourth, maybe I am just a traditional kinda gal that I find this whole topic creepy. Sorry I read this and got intrigued about whether a transgendered person could get a visa or not...but I donnot care, kinda scared to know more about the whole biology of it.

and Lurker...your comments bashing American women are very telling! Jeez, I just spoke about people like you in another thread...can you not just be all 'I love my fiancee' instead of bein all 'neeener neeener, American women suck!'
