Hi guys!

My husband and I are preparing all the required documentation for AOS. We have couple of questions

1. Is it preferable to apply for a SSN card before submitting AOS? (My fiance now husband arrived to the states a week and half ago and we are planing to apply for the SSN on tuesday). We want to submit our AOS paperwork as soon as possible so my hubby can enroll in English classes and find a job.

2. On the SS-5 application (SSN Card), question 5, should we check option " legal alien NOT allowed to work" or "other". We had read the instructions here and we still a little fuzzy about this part.

You check legal alien allowed to work. Scroll down on the page from the above link to K1 and look at what it states there beside it in citizenship field. (of course you can't work with it until you get EAD) Print that form out and take it with you to show SS office as stated in this guide

There is no preference for AOS, but it is nice to go ahead and have it.

Hi guys!

My husband and I are preparing all the required documentation for AOS. We have couple of questions

1. Is it preferable to apply for a SSN card before submitting AOS? (My fiance now husband arrived to the states a week and half ago and we are planing to apply for the SSN on tuesday). We want to submit our AOS paperwork as soon as possible so my hubby can enroll in English classes and find a job.

It is not required for AOS, but you should go ahead and get it while his I-94 is still valid. That way he will have his SSN ready to go for when he receives his EAD. SSN can also be needed for bank accounts, insurance,getting drivers license, etc.

2. On the SS-5 application (SSN Card), question 5, should we check option " legal alien NOT allowed to work" or "other". We had read the instructions here and we still a little fuzzy about this part.

A K-1 is a legal alien allowed to work. That is what you check off on the form.

He cannot legally work though, until he has his EAD. You say you want him to get the SSN so he can work, but the SSN does not make him eligible. He is legally able to apply for permission to work.
