I recently paid the usd 88 AOS fee and received a document cover sheet that asked me (the petitioner) to submit an Affidavit of Support (AOS).

I am petitioning my Norwegian husband and we currently live in Norway and own no residence in the US. I am unemployed and he makes all the money for our family of four. Can he not "sponsor" himself? Besides the fact that we won't move until he gets both a green card and job in the US, he has cash over the 125% of the poverty line for a family of four x 5.

I also read the following on the State Dept website: "If you filed an immigrant visa petition for your relative, you must be the sponsor. You must also be at least 18 years old and a U.S. citizen or a permanent resident. You must have a domicile in the United States or a territory or possession of the United States".

I do not have a domicile although I am the petitioner. This is the first that I have heard that I needed to have property in the US. We moved to Norway with the intention of moving back to the US with our children, though I am not certain that 16 years in Norway is considered temporary.

I hope this does not mean that I am not a valid petitioner. If it is an issue, I am certain that I can have my family in the US transfer some land to my name.

Any help I can get on these issues are greatly appreciated!

You've misunderstood the domicile requirement. You don't have to own a domicile. You must establish domicile.

Transfer some savings to a US bank and the asset requirement will be 3X rather than 5X.

The I-864 FAQ link in my signature below has good info about establishing domicile.

You don't need to own land, don't worry.

Whew! Big load off my mind. Thanks for the link. It is informative and to the point.

I still have the issue with my husband being the bread winner. Can he "sponsor himself" or do we have to get a joint sponsor?

Thank you for the link. It answers a lot of my concerns. I guess my husband may need to transfer his money into my account since I am the sponsor? I find it strange that he cannot fulfill the monetary requirements himself since he has the means...
