Hello everyone,

This really seems like a good site for help! I have been going with a lady from the Philippines for almost two years now. We are just about to get her anullment completed. I have lived with her in the Philippines for almost a year but I am now back in the states. I am preparing my K-1 application and I want to be sure I have everthing that they want from me the first time I send it. I have been married twice and I am sending a copy of the divorce papers. I'm guessing she would need to fax her anullment to me so I can send it also. I dont think it asked for these papers, the only thing I see on the application is the dates and place of divorce. Do I need to send in last years income taxes? I have a small ranch that is paid for but I dont show alot of income because I have alot of deductions, is this ,going to be a problem? I am from Colorado and not sure which office to send my application to and not sure what the fees are as I have heard they have changed. I would appreciate any help I could get as I leave for the Philippines on the 1st of September.

Yes. You need to send proof that you are both legal and able to get married. This includes copies of divorce and anullment papers.

Tax and income information are not needed for the initial petition. They will be required at the interview later on down the road.

For fees and where to send your application, please read the I-129F instructions. Both questions are clearly answered there - if you missed that, you might have missed other things. Go re-read.

Welcome. Yes, this site is generally a great source of information. Evylin basically covered your questions here. The I-129F instructions will list the current petition fee and address to send the petition. You do need to prove that both of you are legally free to marry. You should :guides: from the link at the top of the page. This will help you immensely. Your income is not an immediate concern with the petition. However, you will need to provide this at the interview with the I-134 form and supporting evidence. The annual income needs to meet the 125% poverty level. Although you are at the stage of putting your petition together, the links in my signature will be beneficial to you after you have gotten approved and planning your interview. These links are Manila specific.

You download the forms and instructions from the USCIS website. You will not be applying for a K-1 visa just yet though. The USC must send in the I-129F Petition for Alien Fiance(e). Once that is approved, the foreign fiance(e) will be able to apply at the US consulate in their country for a K-1 visa.
