Hello guys ,

I received in 2010 a date for SC appt notice , but i didnt show for the appointment because iam outside the united states , and i want to go back there , so i checked online for my case i get this

So now i called them and someone answered with understandable language , and i had to keep saying my words and he says i cant understand , anyway i didnt get 1 information from him so i decided to ask you here .

Questions :

Since i didnt show for the ASC Appointment and been away of united states for more then 2 years and i cant go back with expired green card to that appointment , what should i do ? to know whats going on with my case , how can i know what to do ? i dont really know anything

how can i get back to united states , and iam married to american citizen for 8 years now .

Please need responds and helpful responds asap guys

Your green card was cancelled since you did not show up for the fingerprinting appointment to remove your conditional status.

You say you have been married to an American citizen for eight years, so you would have married around 2004. How was it that you had a conditional green card for a marriage that (by 2010) would have been well over two years old, and closer to six?

If you wish to return to and live in the United States again you will need to file for an IR-1 immigrant visa. These currently take 8 - 10 months to process; less if you qualify for DCF.

Your case is probably considered abandoned via several different criteria. You will have to start over from the beginning.

Okay u r out of the US still and have not been back for 2 years. I do believe your greencard is revoked I did you apply for permission to be gone so long (sorry don't know what its called).

Since you are out the country I would think your spouse has to start the process over again and position you. To keep your greencard you have to be in US more than out in a given year.

I am sure others will come with far more in-depth advice and knowledge.

I am curious myself. Sorry don't have the answers for u.

• Remain outside of the United States for more than 1 year without obtaining a reentry permit or returning resident visa. However, in determining whether your status has been abandoned, any length of absence from the United States may be considered, even if less than 1 year
• Remain outside of the United States for more than 2 years after issuance of a reentry permit without obtaining a returning resident visa. However, in determining whether your status has been abandoned any length of absence from the United States may be considered, even if less than 1 year
• Fail to file income tax returns while living outside of the United States for any period
• Declare yourself a "nonimmigrant" on your tax returns
