Should I wait for Deferred Action?

Hello,

I'm about to send out my application for Adj of Status and everything that goes with it.

Yesterday I found out about the Deferred Action Imm. Program, which I fall under!

Now I'm not sure which I should do. I know the Deferred Program doesn't guarantee

citizenship but I think that I'll receive my EAD faster then going through the whole application process for AOS, EAD and then citizenship.

I'm thinking of applying through the Deferred Program and later on slowly reapply for rest, if possible.

Just looking for some opinions! :blush:

The more I think about it, I think I'd rather wait for my citizenship.... :bonk:

The last thing I need is the laws changing in the future and screwing me :/

it's not citizenship, it's residency. you will get a Green Card and become a Legal Permanent Resident. you still have years to go to get citizenship after GC.

the deffered action isn't worth it.

Deferred action was GREAT news but it is not perfect, nor is it complete. There area a whole lot of restrictions that come along with it, one of it being traveling overseas. Send in the AOS, as long as you have everything in order, and be on your way to permanent residency ! Good luck !

Day 0.....4/03/12 - Package mailed to Chicago via USPS Priority Mail
4/06/12 - Delivered!
Day 7.....4/10/12 - Email Acceptance Confirmation for all 3!
Day 13...4/16/12 - NOAs for I-130, I-485, EAD received in mail.
Day 16...4/19/12 - NOA for Biometrics appointment Received. Scheduled for 4/27/12.
Day 20...4/23/12 - Biometrics appointment completed, early walk-in at different location!
Day 66...6/07/12 - EAD Production!!! Lucky, 2 days before this we submitted a change of address from ND to PA
Day 70...6/11/12 - 2nd EAD Production 6/12/12 - EAD mailed! Interview scheduled for July 13th!

Day 73...6/14/12 - EAD in hand!
Day 82...6/23/12 - We mailed letter to old Office to confirm change of address and cancel our July 13th interview. Received NOA for an Interview scheduled in Philadelphia Office on July 24th!
Day 92...7/03/12 - July 24th interview was cancelled (file did not get in on time). Got NOA for interview on August 9th!
Day129..8/09/12 - INTERVIEW! Received card production email 8hrs later!
8/10/12 - Email NOAs, approved I-130 and I-485!
Day138..8/18/12 - GC DELIVERED!!! Emails received: 2nd card production email on 8/15, card mailed on 8/15, card picked up by USPS on 8/15.

12/13/12 - Filed for divorce 8/2/13 Entered Divorce Decree

Deferred Action gives you only EAD. You will not get a green card or citizenship through that program. If you are eligible for adjustment of status, you can file for AOS, EAD and AP at the same time. EAD/AP combo card is usually approved in a month or so. If I were you, I would read very carefully what is the deferred action.

If you are eligible for AOS I don't understand why you would want to do deferred action? There is no telling how long that will take you and there is no pathway to becoming legal. An EAD with AOS only takes 3 months, I would be stunned if you got it faster with deferred action. Deferred action is ideal for people who have no legal pathway.

If you have a choice between deferred action and AoS then it's a no-brainer, forget about deferred action and go with AoS every time.

Deferred action could be removed at any time by the stroke of a pen of any future president (in the same way it was brought into existence by the stroke of a pen of our current president). Whilst Mitt Romney won't confirm that he would remove the program, since he's a Republican (sometimes...) then it is a risk.

Go with AoS.

I thought it would maybe be longer, but yes, you never know what might happen down the road with the deferred action.

we don't even know how long the deferred action applications would take to be processed, let alone approved...also last I read, deferred action doesn't even grant legal status. Send in your AOS :)
