Hi,

I am Pakistani and my wife is a US citizen, We got married on the 4th of July almost a month now, its a love marriage. my wife 4 days after our marriage left for the states she is there now, we have filled out the docs and i will be sending them to her in a couple of days along with pictures and 325a, she will be sending them to end of next week.

The question that i have is, she intends to come back after 3 months time so that when we leave we go together. she has a job and makes above the required level of 18000 per anum. Will our interview come during this time period ? if she comes here and then we hear for the interview, can we give it here even if she has submitted the documents there ?

Note: we don't have a joint account, what is the sort of affidavit we need, can our friends and family write down along with their address ?

We had only one function with about a 100 guests, we couldn't afford events.

Any help will go a long way.

15th August 2012 I-130 Sent
21st August 2012 I-130 packet Received Email confirmation
24th August 2012 NOA1 received email and mail - petition transferred to Lee's Summit, MO.
4th September 2012 NOA1 status on USCIS, case transferred to USCIS office
Update: 11th Nov 2012- Found out case is in Houston Local office since Nov.

April 15th 2013 - I-130 Approved (NOA2)

July 2013 - Petitioner (wife returns to the US) and starts working.

September 2013 - Decided to file with NVC.

October 2013 - Submitted DS-260 got approved.

November 2013 - Submitted civil documentts IV packet.

December 2013 - Received email from NVC that documents are complete

January 17th 2014 - Interview - Put in AP for 1 to 3 Months.

sorry i forgot, can we file a k3 while the application is in process?

The K3 is obsolete. It would be closed at the NVC.

You said she is coming back in 3 months will that be time for interview.

The answer is no is I am understanding you. If she files u say in a week it will be 5 to 8 months at USCIS than another 2 months probably at NVC than waiting for interview could be another 2 months.

Also you have to realize that most visa application at Islamabad go into mandatory AP which could take weeks or months.

Realistically you are looking at a 10 to 12 months process.

Realistically you are looking at a 10 to 12 months process.

dhweels is spot on... there is no way you would be getting a visa within that time frame and the most realistic time is between 10 and 12 months if there is no AP. AP for Islamabad males is very common and lasts anywhere from a few months to a year or longer. Focus on getting all the require documents. Yes you can send affadavit of bonafide marriage letters from family and friends. Be sure she gets them notarized here in the states from her friends and family and you get yours notarized there.

If she wants to be there with you at the interview have her try to time it so she makes plans after you get your NVC section completed... usually they schedule interviews within a month or two after the NVC process.

CR1 is the path you will be taking as dhwheels said the k3 is obsolete and ends up being a CR1 at the end anyway.

Forget the K3.

Yes she can come back to live with you, and your interview will be in your country anyway. However, she should have someone check her mail back home regularly in case she gets an RFE (request for evidence). Keep in mind as the above poster said from filing to your interview will be 9-12 months, and most men from your country, especially muslims, go through additional security checks after the interview for weeks or even months.

If she moves to live with you, how will she keep the job?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

thanks for your replies, hmm i messaged the us embassy in islamabad they said i can apply for a k3. the us embassy has shifted to karachi as well so interviews happen in my city now as well. Penguin she will be quitting her job but she has well over the poverty line earning in her last 3 year tax returns.

You need to remember that the petitioner is required to show continuing income sufficient to meet the guidelines. While her taxes for the last three years may show her income at that time as enough she will be required to provide things such as current pay stubs and a letter of employment to prove that income is continuing.

I don't think you are understanding. The K3 is obsolete so it gains you nothing to file.

You say she is quitting her job. But when time comes for Affidavit of support she will either need to be working at a job over poverty line or you will have to secure a co-sponsor. It matters not that pass 3 years she was above the poverty line. Its what she is making now.
