Time between I-130 and i-864

Hello all!!

Just getting started on all of this and need some information. My soon to be husband and I (USC) live in Brazil. I have lived internationally for 6 years. We plan to marry soon and start the IR-1 process.

We plan to move to the US after my Brazilian work contract ends in July 2013.

I need help on...

1. How long after I file the initial I-130 do I file the I-864? I know this varies widely, but are we talking weeks or months? I am hoping to secure a job in the states in March or April 2013 and use that job on the I-864 so we don't need a co-sponsor.

2. If the visa is delayed from some reason past July 2013, can I go to the states and he stay in Brazil until the visa is completed? Will I need to return to Brazil for any reason (other than to give kisses to my wonderful hubby)?

Feel free to correct any of my misconceptions...I just started...forgive me in advance :) I promise to help others after I get more experience.

The I-864 is submitted to the NVC after the NVC has received the file, assigned the file a case number, and the Affidavit of Support bill has been paid. You will not be dealing with the NVC until after USCIS has approved the petition and timeframes from submission of a petition to USCIS to an adjudication decision on said petition can vary. Furtheremore, there can also be waiting time between the time USCIS approves the petition to the time the NVC issues a case number to the file (personally, I had to wait 37 days between approval of the petition and case number assigned from the NVC).

Also, if you are unable to meet the sponsorship requirements on your own, joint sponsor is the proper term as to what you would need.

Yes you can go to the States and there would be no reason other than the one you stated for you to return to Brazil.

August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

you will wait months for the 130 to be approved.

no reason to retunr to brazil for immigation purposes other than adding to the evidence that your relationship is real.

but not required.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
