RED FLAG??

So here is my story I came here Sept 2007 with tourist visa(visa will expired 2017) then I met my ex-husband and get married August 2008 lived together till January 2009 but it didn't work out so it ended up to Divorce....Divorce granted on April 2010 but we didn't file any paperwork for me....

Now got married last March 2012 to my Military husband filed AOS and still in process...Do you think I will have a problem in our interview???

Possibly- it could be seen as you "fishing" for a greencard and when the first husband didn't file for you, you moved on to the second.

Be prepared to show:

- why you overstayed in the first place (as you only married husband 1 a year after you entered, and tourist visa stay is 6 months)

- why the first marriage didn't work out.

- How soon after the first marriage ended you found the current husband

- Lots of bonafide evidence- co-mingling of finances, living together, photos etc.

yeah I know getting ready to answer all those question in our interview,my husband has prior marriages too so we really have to be prepare for all the questions...thanks

in my opinion i dont think your case looks bad, seeing that u and your first husband didnt file for status before, this could prove that you wernt trying to get a greencard in the first place

yeah you're right thats what I'm gonna tell the interviewer because if i got married for greencard I should've ask my ex husband to file paperwork for me right after we got married.. the only thing why it didn't work out is because of his parents they are really racist(they're VIET) so they want their son to marry a Viet too....and I'm gonna tell them too that if I want greencard that bad I shouldn't wait for another 2 years to get married again...

You will be fine.

Yeah our divorce was finalized last April 2010 so I can prove that its been 2yrs before i got married again..thanks God Bless:-)

What kind of bona fide marriage documents do u have right now? were only married 4 mos ago so Im just curious..and why you dont have to take bio?

But do they really check if someone had applied for AOS from previous marriage or not?

I hope they just don't assume or guess.
