My wife and I filed the paperwork for AOS on both of her boys at the same time. Sent in one package / two identical sets of paperwork except for personal information and payment checks/amounts. When we filed the AOS documents they were Daniil (11) and Vlad was (17). Initially we had sent the incorrent amount for Vlad and had to send another check. This put the boys "out of sync" make a very long story short. With the exact same paperwork one boy (Daniil), now has his green card (6/11). While Vlad just received his notice of denial today, (7/11). There is no appeal only the ability to file a motion using the 290B form. I am devestated as this whole process has taken what little money I had. Now it seems I need an immigration lawyer. I love my country but I would sell their souls at immigration for a shiny penny about now.

I'm not super familiar with I-485 denials, but does the notice offer any clues to WHY it was denied?

By the way, I really suggest Laura Fernandez and Lizz Cannon. Both offer free initial consultations and they might be able to help you get on the right path without even having to hire them for the process. Links to their websites are in my signature. I really encourage you to use a lawyer who is trusted in the immigration community, because a lot of immigration lawyers are not always well-informed about these things but take your money anyways. Filed I-130 via CSC in Feb 2008. Petition approved June 2008. Consular interview in Mexico, Oct 2008, visa denied, INA 212a6cii. We allege improper application of the law in this case.

2012, started over in Seoul: I-130 filed DCF on 7/2, I-130 approved 8/8, Medical at Yonsei Severance 11/20, IR1 appointment in November 2012.

Why was the case denied?

08.06.2010 - Sent off I-485
08.25.2010 - NOA hard copies received (x4), case status available online: 765, 131, 130.
10.15.2010 - RFE received: need 2 additional photos for AP.
10.18.2010 - RFE response sent certified mail
10.21.2010 - Service request placed for biometrics
10.25.2010 - RFE received per USCIS
10.26.2010 - Text/email received - AP approved!
10.28.2010 - Biometrics appointment received, dated 10/22 - set for 11/19 @ 3:00 PM
11.01.2010 - Successful biometrics walk-in @ 9:45 AM; EAD card sent for production text/email @ 2:47 PM! I-485 case status now available online.
11.04.2010 - Text/Email (2nd) - EAD card sent for production
11.08.2010 - Text/Email (3rd) - EAD approved
11.10.2010 - EAD received
12.11.2010 - Interview letter received - 01.13.11
01.13.2011 - Interview - no decision on the spot

As the others have mentioned, we need to know why the denial happened. Did Vlad turn 18 by any chance?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I was told we "abandoned" the case, which is crazy, but if there is a lesson here, do not get lax in the way you document your case we did and it is going to cost us $1070.00 we don't have. And yes Vlad turned 18 during the process.

Did he leave the US at any time?

Also, his AOS was based on being a derivative of your wife's petition. When you had to resend his packet you probably should have included a copy of the NOA1 for your wife's I-485 so that it would still be considered to have been concurrently filed.

05/01/2013 - Removal of Conditions - APPROVED!
