What to do: Applicant Born in Vietnam Has No Birth Certificate?

Hi all,

We have a problem that we are hoping all the knowledgeable folks on this forum can help.

I am sponsoring my wife's green card. I am a US citizen and she is a Canadian citizen. She was born in Vietnam, but left when she was only 5 days old. She never got a birth certificate from Vietnam.

We are now at the final stages with NVC. According to this link: http://travel.state.gov/visa/immigrants/info/info_3195.html, she is required to submit birth certificate or a non-availability of birth certificate + affidavit. Our questions are:

1. We read on the forum that there is an exemption for refugees from Vietnam. Is that true? If so, where is the official link that states this?

2. Would it be acceptable if we just submit 2 affidavits of birth, 1 from each parent? That is what we submitted to USCIS for I-130 originally, and they accepted it.

3. If we really need to get a non-availability of birth certificate from Vietnam, where and how do we get it?

We are hoping that someone on the forum can help. Thanks a million.

Thanks for your response. Yes, we have not been able to find anything on Google.

We have what we provided in the I-130, but we are worried that it won't be sufficient.

Hi J & V,

I just came across your posting and jsut see how it turned out. I am in the same situation,so if anyone can assist is much appreciated.

USCIS came back to me and said i need to submit a birth certificate or a secondary evidence. I am having a really hard time on this as i was never issued a birth certificate when i left Vietnam. I am now a canadian Citizen with a canadian passport and now applying for my Green Card in the USA.

Do anyone have any information or guides on how about i can get this sorted out?

Timeline

Find some government issues form/paperwork with your parents' names and Birthdate on it. Write up some explaining letter and attach the copy of your parents' passports with it. If your parents can sign and notarized the letter is even better. Don't know of this would help but good luck.

Was your wife able to get her green card and what steps did you take to do this? I am in the exact same situation - my family fled Vietnam in 1976 to become refugees in Malaysia. We were then sponsored by my uncle in Canada, where we became Canadian citizens. My parents did not leave with any birth certificates for any of their children. I am now applying for a Greencard and received a Request For Evidence for a birth certificate that I do not have. 
 

For anyone in a similar situation, what was your outcome and what steps did you take? I’ve read from a few posters in a similar situation but there was never a follow up, so would really appreciate ANY guidance or hear about your experience. Thank you!
