Change of Status from B2 (California)

Guys I need your help...me and my wife got married back in December when i was visiting for 2 weeks (confidential marriage for family issues) .Now i came back in mid June and her family issues solved .we will have a wedding party and I will apply for change of status from b2 to GC...What i want to know is that ..Where i should start ...What is the time frame for the work permit as i need to work...how much this will cost ?

Once filed and provided you don't receive any Requests for Evidence (RFE) you can expect to receive your work authorization within 90 days. Fees are currently $420 for the I-130 and $1,070 for the I-485. You will also need to complete a medical that will cost you some amount of money -- this generally ranges from $100 - $500 depending on the doctor and if you need additional vaccinations.

You cannot come in with a B2 with intent to immigrate. B2 is not a dual intent visa .

I am not sure what the current time frame is for the work permit - when I did my AOS, it came the week after my interview. blink.gif So, pretty much useless to me! However, it is going to cost you $420 for the I-130, and $1,070 for the I-485. If you file the EAD form (I-765) with the rest of the package, it does not cost anything additional.

You cannot come in with a B2 with intent to immigrate. B2 is not a dual intent visa .

At no point did the OP say they came in with the intent to immigrate.

Edited to correct when I received my EAD, according to my timeline and not my crappy memory.

If are already in the US your wife will need to file a request for your residence - form I-130 - and you will need to file the I-485 to adjust your status. In the links below you can find the forms, instructions how to fill them out and the cost to file them.

Just relax, and read the guides through a few times. It really isn't so bad once you get started, and search this forum for answers to your questions. If a search doesn't work, post a topic, everyone here is very helpful.

I don't want to be one of those people who yells that you've done something wrong or anything. But I have to ask..

Did you use the same B-2 to come back in June that got you here in December? Did you know you'd be staying when you came in June? Were you asked anything when you came in the second time about whether or not you intended to stay?

I'm not asking because I want to yell at you, I promise. I'm just thinking these are questions you should have answers to before you go to an interview.

IMHO instead of asking these questions, why dont you tell the poster of the consequences of each possible scenario, from the ones you are presenting? (And I do not mean this the wrong way. It is just that these questions may put one on the spot and may end up being alienating.) Peace!!

OP, the concern that DandT14 has, is if you misrepresented yourself when you entered the US - ie: did you lie to a border guard. Intent alone is not a reason to deny your AOS application, but lying to an official is, and it gets you banned from the US. So, if a border guard asked you what the purpose of your trip is, and you say visiting friends - meh, that's not lying, it's just not telling the whole truth and you are OK. However, if he/she asked you are you married to a US citizen, and you said "No", it would be a problem IF he recorded it.

ok so the thing is that he yes asked and said visiting my friends (and give them names of my friends )and i'm really staying with these friends until i can move and live with my wife ....and the other issue is that he asked if i'm married or single ...My passport said i'm single so i couldnt say other than that and our marriage is confidential so its confidential by "law" i hope he didnt record that anyway

I am out of my depth here now. Hopefully, he didn't record your answer. From here on out, no matter how painful, always be honest (if not necessarily forthcoming) to US immigration officials. If it becomes an issue, there is a waiver to overcome your inadmissibility due to misrepresentation, but I have no idea how it works. I don't understand what confidential by law means, but when you file your paperwork, you have to put the date of your wedding on it, and they will see that you were married before your last trip into the US. Likely not a problem, unless they ask you "did you tell the officer when you entered that you were not married" or some such thing. If they do ask you that, I would assume they know.

Some states issue confidential marriage licenses. I'm guessing that's what the OP means. But I'm pretty sure USCIS doesn't care if you have a public license or not.

But, maybe it gives you something to tell them if they ask why you didn't tell the agent you were married. You can say "I thought my confidential marriage license made it so I was supposed to say that." Maybe?
