Hi! Me and my husband is starting to gather data for our I130.. I had a question about sworn affidavit of third party, will the affiant state my name in my married or maiden? I have confusions here. As of now we did not hire a lawyer and just try figuring this out on our own. Good thing there is site like these that is much better than a hiring a lawyer I guess. That's my question goes, like I give you sample

"Evidence in support of a bona fide marriage between Petitioner's Name and Beneficiary's Maiden or Married name?" I am confused what will the affiant shall put.. If it will be put in maiden my I-130 is in married name. I have an affidavit here from one of my principal sponsor and my name is all stated in my maiden name.. Is the affidavit okay? I have question in mind it might go against my i130 beneficiary name.. Pls help anyone..

Sworn affadavits are not really necessary, assuming you have enough other bonafide evidence. If you want to use them, I suggest the witnesses use your married name, unless their knowledge of your relationship is soley from before you were married.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thank you Penguin_ie for your reply.. We dont have enough bonafide evidence that is why we like to use the affidavit of witness. All of my friends and family who will help me with this affidavit know our relationship even before marriage until I get married. I have one principal sponsor who gave me his sworn statement notarized. In the affidavit he used my Maiden name. Here he what depose:

1. I personally know (My Maiden Name) who got married to (My Husband's Name) on (date of our wedding) and (place)..

2. Narration of how he knows our relationship until he witness the wedding. Mentioning my name in still in my Maiden.

2. I hereby testify that the relationship of (My Maiden Name) and (Petitioner Name- my husband) is authentic and not enter in immigration purpose.

I thought this was okay, but when I saw other samples of sworn affidavit here this starts my confusion. When I saw this statement from a sample I bumped in this site "In the Application for a Visa for the United States of America. Evidence in support of a bona fide marriage between (Petitioner my Husband) and (if I put in my Maiden name) in my husband form i130 filed letter C (information about a relative) No.1 My name is in married. But there is No. 7 still in letter C "Other Names Used (including maiden name)" its where we put my maiden name.

So would it matter if some of my third party affidavit will be in my married and some in my maiden.? I am going to accompany my parents and my in-law to notarized there sworn statement today. I dont know if whats right to mentioned me there in there statement, is it in Married or Maiden? They have known my relationship since we were still in the getting to know each other stage and they witness also my wedding. Hope you enlight me more Penguin_ie for this confusion. Thank you so much!

What name are you using for your I-130 petition? Married or maiden name? What ever name you are using for your petition should be the name used for your affidavits. I think it's important that all your affidavits have the same name on them. How can these people say they know about you and your relationship when they don't even know your name.

To be honest, I think it doesn't matter at all. I put my husband's last name as my last name, but my last name has never been or will be legally changed. I love my last name too much :lol:

01/13/2012: DS-3032 emailed

01/27/2012: Barcode arrived via e-mail

Hi anyone who had knowledge about this.. Pls help..

It doesn't matter whether affidavits mention your maiden or married name. When asked on the G325a and I-130 about other names used, I suggest following this example. First Middle MAIDEN, MARRIED

Facts are cheap...knowing how to use them is precious...
