I have a buddy that is from Canada who has been playing professional Hockey here in America for the past 15 years. Every year the Hockey team that he plays for is able to get him a work visa for the hockey season and every year he returns home to honor the Visa and not to stay out of status. My friend was once married to an American citizen 12 years ago but did not file for adjustment of status and was divorced a few years later. While he was married to her they had a child together and now his USC daughter is 11 years old. He has saved every I-94 form that he was given and has never been out of status with US Immigration. I am trying to see if i can help him establish permanant residency so he can work here in the US to help support his USC daughter and help raise her. Is it possible now? I know he will be able to establish permanant residency once his daughter turns 18 in which she can file the I-130 on his behalf. Is there a way to do it now? If not permanant residency, could he possibly get an EAD and AP and just renew it every year?

hi,

the daughter has to be 21 to file for parents, not 18, so he'll have to find some other way or wait in Canada until his daugther turns 21, and of course there has to be a relationship between them. is he on her birth certificate? is he paying child support?

I appreciate the input but what other way? He has her half of the time and is finacially responsible for her. I am looking to find out the other way that you are talking about. Thats were i am stuck.

maybe some type of job within the organization? he should find out if there is any job position open within the organization that they could file a work visa if they are interested. has he made any connextions within his profession? maybe sportscaster on a cable show, anything that has to do with hockey.

His US citizen daughter must be 21 years old before she can petition for dad. She can't help him get a green card before her 21st birthday.

Only a US citizen spouse can quickly get him a green card.

His only hope seems to be if his employer is willing to spend the money for a work visa so he can continue in some capacity with his team after his playing days are over.

also the daughter at that age has to have the monies to show that she can sponsor his dad or she must have a co- sponsor(??) I knew of one where it remains pending until now(for years) but not denied due to money problems..no itr, not enough income, etc
