Has anyone run into issues with adding a beneficiary to a mortgage? I actually own two houses and was told by my mortgage company that I couldn't just add my husband to my mortgage without a complete re-finance (which I JUST completed on one of the homes right before we got married!) He suggested getting him added to the title, but I wasn't sure if that was even going to be worthwhile in the long run or even possible (I haven't called the title company yet).

Any other petitioner's run into something similar? How did you get around it since I know this is a biggie...

You can add your husband to the deed, but not the mortgage without refinancing. You should check with your mortgage company to make sure this wont trigger a "due on sale clause". My husband is on our deed, but not the note & mortgage.

Yes check with your mortgage company. But usually spouses can be added to the deed without triggering that clause.

If you just want to do it to be an evidence of bonafide marriage, you don't need to.

My husband has the morgage and has not added my name because of all the hassle, we have others evidences to prove. At the interview, we just told IO that my husband owns the house. :)

From what I've found out, you can add them to the Title by using a Bargain and Sale Deed. NOT easy to find, but the lady at the title company took pity on me and gave me two copies of the legal document today. I had to mail it to the county for processing. Basically it is what I would have had to do to change my last name anyway (probably wouldn't have cared because it was such a pain!) but since I'm up to my eyeballs in this stuff anyway, what the heck, right?? :P

It just depends on the state and the terms of your mortgage--there's no special form that applies to everyone.

But, like others have said you can't just add someone to your mortgage. You need a whole new loan for that. You can add anyone to the title though. At one point I had like 5 people on the title to my house. (Don't ask. :huh: )

How did you get around it since I know this is a biggie...

It's not "a biggie". It's one piece of evidence. We bought our house when I was here but without a credit history/score the interest rate would have sucked so I am NOT on the deed or the mortgage. I am on some piece of paper as his wife (for survivorship reasons) but that's it.

You can also do a Will and Powers of Attorney. You can have joint bank accounts and credit card and all manner of other things. The mortgage/title absence won't mean you'll be denied. Don't stress.

Yes, a Quitclaim Deed can work too, and I'm sure it varies from state to state as well! I'm in Oregon. Investigate your own laws from your own county recorder. My title company was quite helpful!

If you're doing this for proof of a bona fide marriage, don't worry about it too much. Just have the utilities bills in both names or something. Prove that you both live there. That's all they're really looking for.
