My new filipino wife has a 7 year old child from a previous relationship. She never married the father, but he is listed on the birth certificate. I've looked through the I-130 process for bringing my new stepchild to the US and it doesn't indicate anywhere that we need to obtain the consent of the father, but my wife is nervous that he could get in the way of the process somehow. He's barely involved in her child's life and stopped providing any financial support once she married me, but he is controlling and I doubt he will give consent if he has any say in the matter. From what I've read online, since he never married her she has sole custody of the child under Philippines law.

Has anyone run into a similar situation? Is this a real problem, and if so is there a way around it?

Hello, i myself got a 7y/o child from past relationship, never been married before my present husband as well.. But the diff. Of my situation from your wife is i didnt include the biological father from my child's BC.. So i will suggest that she will see a lawyer regarding that. Cuz they seem to have communication cuz of the child. Unlike me that im free from headaches.

March 26, 2009: We become a couple!
September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!
June 21, 2010: Engaged!!!
September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

July 23, 2025:  Filed N-400 online

December 9, 2025:  N-400 interview

You don't need the consent of the biological father even if his name is listed on the child's BC and/or even if the child is using the father's surname.

In the Philippines, an illegitimate child is under the full custody of the mother. Lots of Filipina women with children from past relationships are able to immigrate with their illegitimate children with no problem from the fathers.

You can file i130 for the child as soon as you marry the child's mother.
