Me and my boyfriend wants to get married so that I can move here from Sweden. but what way is the best way to do it? I am currently in the US for the summer.

We thought about the option about getting married this summer, and then file for a CR-1 visa. Is it a quicker way, to file for a visa for a family member? And does it matter what country the family member comes from?

Or should we do the K1-visa?

I would really appreciate your thoughts and help in this matter!

That is considered immigration fraud. You should be careful what you post. Getting married for immigration purposes is illegal.

Sorry but what the poster said is not immigration fraud.

You can come vacation in the USA and get married - there is no fraud in that. The fraud happens when you have the intent to marry in the USA and adjust status after while still in the USA.

The poster is suggesting something legal and can do the option of marrying filing the CR-1 then returning home when the vacation time is up.

It's not that we do this cause I want to immigrate, it's because we are in love and want to live with each other.

Not sure what the last post saw that said it was considered fraud...DIdn't read it that way myself.

To your questions:

If you do get marry this SUmmer, proper procedure is that you return to Sverige while he files CR-1. Once approved you would be back and be given a green card upon arrival. Takes about 1 year end-to-end from the time of filing.

Alternative is a K-1, for which you do not marry, still return to Sverige and wait for approval, upon approval you come and marry within 90 days and then adjust status. This in average is running 8-9 months end-to-end since time of filing. But, notice that you have to adjust status while you aer already in the US. That is another 3-6 months. Adjust status means among other things you cannot work until you get a work permit (on CR-1, you can work the same day you set foot in the country. Additional there is an extra cost.

Sverige is not a particularly 'hard' country; thus, you should get the approval in either case within the average times.

WHile process is on, it is technically possible to visit in the US, but it is also possible that you get deny entry (in the assumption that you would stay to complete the process). Yes, crazy, but it happens, so then there is that risk.

No need for a lawyer unless you have a complex case. Most people here have done it themselves without a hitch. If you can give some details of your case, people here will be able to advice if a lwayer would be needed. Generally, a lawyer is needed if you had overstays, had been in jail, have history of drug abuse, spouse to be had had encounters with law enforcement, etc.

I think the person who thought this was fraud thought that the OP was saying that she wanted to get married for the purpose of moving to America. I think they took what the OP said out of context.

05/09/2022: SSA Citizenship Status Updated.

05/25/2022: Naturalization Certificate received in mail.
