hello im spouse of lawful permanent resident can i fill student visa to study their while waiting procee my pririty date is april 2011 when ill do the interview her in morroco or in us

you can apply, but the VOs will wonder why you would depart the US after your studies (a requirement in order to be granted a student visa)...and what are you going to tell them? Student visas are not designed so somebody can 'hang out' waiting for their petition to become current...student visas are for serious students who have convinced a VO that they plan to depart the US at the conclusion of their studies...

If you have the money (US college fees are expensive, and you cannot work during your time on a student visa) and the pre-requisites to be accepted into a college, it is definitely worth a try.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

If you have the money (US college fees are expensive, and you cannot work during your time on a student visa) and the pre-requisites to be accepted into a college, it is definitely worth a try.

However, what is he supposed to tell the VO as the overwhelming reason he will return to Morocco after completing his studies instead of staying put with his LPR spouse? That should be an interesting story. :unsure:

However if you're accepted to a good upper level programs like Master's or Doctor's, I think there is a chance. If you're just applying for a student visa with ESL, it would most likely be turned down.

There is a chance student visa will be granted. In general, it's difficult though because you're applying for non-immigrant visa while your immigrant visa is pending. However if you're accepted to a good upper level programs like Master's or Doctor's, I think there is a chance. If you're just applying for a student visa with ESL, it would most likely be turned down.

What do you wish to study?

US is a big country, it may well be the best bet educationally is nowhere near where your SO lives.
