hey guys I want to know if my.wife can apply.for any sort of tourist visa while her I-130 is still in process and "initial review" ... the thing is my wife who.resides in bahrain will be free this summer starting july I however have college... we had been talking.for a little over a year .. phone ..skype.. viber .. oovoo and last feb we decided I.would visit bahrain and if things worked out we would hold a religious/legal wedding with a small reception for her close family and froends in bahrain .. and I would return and file for I130... as I.did on may 4th.. and once she gets her cisa we would hold big cultural wedding in bahrain and a reception in the states .. but now its been like 3 months n my wife and I are missing.each otha like crazy she wants me to.visither again but I can't due to college she is however free so is there any way she could come to visit me? ? any.type of visa or procedure that will not.impact the I130 petition in a negative way? thnx in advance to.those that can offer advice ..

she may file for a tourist visa, however with the implied immigrant intent with the filing of the I130. She should show how she must return to her home country with her ties

It is not up to me, you need to ask the CO if it will cover it. But it is a good tie

She can apply for a tourist visa at any time. Doing that doesnt have any impact of the other petition. No one here can tell you or her what the actual outcome but its unlikely she would be approved. Even if she is approved for a tourist visa she could be denied entry at the POE.

All people with any type of visa are considered intending immigrants. You have demonstated her will to immigrate with the 130. In order to be granted a tourist visa she would have to comply with the strongest ties rule. This means she has to prove beyond doubt she must return. That can be very hard to do with a pending petition.

I do not know about applying for a tourist visa, because my spouse has a multiple entry tourist visa. However, I am hoping and praying for the best when he passes through POE on his way here. I have been told as its mentioned here, that even having a visa is no guarantee.

I wish you two the best. I think the visits they say are necessary to prove ongoing and real relationships but then they make it difficult to do just that.

hmmmm WOW that would suck ... argggghhh the complications! why would anyone not go back if they already have an I 130 ... a legal way to.come back ... like why would anyone stay illegally when there is a legal way for them to.come .. wth!

Many people dont go back when they learn they can stay & legally do an AOS ( adjustment of status ) that would enable them to stay.

This can be hard to understand for all of us but your wife may be able to use her tourist visa while she waits for her other visa. This may be due to her past history of returning to her country. Its important to note that it isnt easy to even get a tourist visa from Egypt for anyone so having it means she porved she would return.

I received a 10 year B2 visa, after my wife and I got married. The CO asked me how long we would stay, and since we are both teaching in Korea, they didn't have any problems, as we went there during our summer vacation.

Now, we filed for my CR1/IR1 visa, and my interview is coming up, and I still have a 10 year B2 visa in my passport. It is possible, as long as you can show that you would leave the US.

04-04-2012- I-130 filed at Seoul US embassy $420
04-19-2012- I-130 Approved(15 days)!!! Receive Case number and Packet 3.
05-03-2012 - Medical examination at Seoul St.Mary's Hospital(Passed) $170
05-05-2012 - Set Interview date for June 15
06-15-2012 - Interview (Approved) Case completed in 74 days! Could have been shorter!
06-18-2012 - Receive visa + brown envelope.
07-19-2012 - POE(Honolulu, Hawaii)
07-24-2012 - Receive SSN
07-29-2012 - Receive 2 year conditional Green card
08-02-2012 - Apply for State ID: Get 6-year Tennessee state ID.
03-22-2013 - Do written test at DMV for drivers license. Get 1-year Learner permit.
03-28-2013 - Pass drivers license test. Get 5 year drivers license. Done with the DMV until 2018!

Next step - Removal of conditions on green card: May 2014.

04-30-2014 Filed I-751 to remove conditions

05-05-2014 NOA1 receipt and extension of green card for 1 more year while it processes.

06-12-2014 Biometric Appointment

12-29-2014 Approval letter from USCIS with no interview needed! Done with USCIS till 2024 or when I apply for US citizenship. 

12-30-2014 Receives 10 year permanent green card.

It is extremely unlikely they will approve her tourist visa because she is considered a potential immigrant.

Yes, this same question has been asked a number of times before on this forum (and people have even tried applying for that tourist visa) during the I-130 process. But it just gets declined for the same reason mentioned, that they don't give tourist visas to people planning to immigrate. Don't bother even, unless you have time and money to waste. The only way to get the spouse here faster is if the case qualifies for an expedite (which you can apply for if your case meets specific criteria. I don't have that criteria off the top of my head, but you can find it if you do a search of this forum... it has to do with criteria like extreme financial hardship, etc). Most of us just have to wait like everyone else though.

Edit: I just re-read your post, and I don't think missing each other would qualify for an expedite. We all miss our spouses (at least most of us.. I think). I am also in school and don't get to see my husband until late December next. He has been asking me to come there again (which I would love to go, but can't due to school), and he can't come here without his visa in hand. So I know the feeling. It's a shame that you can't be with your spouse when she has the free time, which is a bummer... but there's really nothing else to be done. :(
