Hey friends,

I have a Fiancé Visa (K1) with me since March 2012 and will Expire in first week of September 2012 coz of some unavoidable reasons I wasn't be able to leave till now and planning to leave in mid June 2012.

All I want to know is it going to make any difference if I arrive in US with less then 3 months left for my Visa Expiry?

As I know that a couple has to marry with in 3 months of arrival of his/her fiancé but is that mandatory to reach before 3 months or I can go even if 2 months left for Visa expiry? Kindly help!

No problem. You could even leave few days before your visa expires, you will still have to marry within 90 days after your arrival in the US. :)

K-1 Visa Timeline AOS Timeline

- Aug 31st, 2011 - Mailed I-129F package - May 29th, 2012 - Mailed AOS/EAD/AP package

- Apr 13th, 2012 - Visa received - Aug 24th, 2012 - Green Card received

Good question I was wondering the same thing. Correct me if I am wrong are you asking when the visa is approved embassy usually give a visa for 6 months.... is that correct? And is the stipulation to enter USA within that 6 month period and get married within 90 days of entry still within the 6 month time frame? Does the visa expire after 6 months and does that make the beneficiary non legal resident in USA at that time?

The expiration on the visa is how long you have to use it. You are usually given 6 months from the date it is issued. It is a one time use visa, so once you use it to enter, it becomes null and void. Your status in the US will be based on the I-94 that you receive when you enter the US. The I-94 will be good for 90 days, and you must marry within that time.

You can be issued a visa this month in June and it will have an expiration date of Dec. on it. You can use it to enter the US at anytime before the expiration date, and when you enter, you will still be given the I-94 good for 90 days in which to get married. The K-1 visa expiration date has nothing to do with that.
