Clear up I-864 items that are Unclear

I'm not a mod and I'm not an attorney but it if I answer a question, you can bet your britches on the answer.

Many of the senior members here know a lot more about family immigration than the vast majority of immigration attorneys do. The money in immigration is for work visas and fighting deportation, not in managing administrative procedures associated with bringing family members of US citizens.

Well I certainly trust anyone that uses the word britches in a sentence.

I didn't file taxes for the 3rd most recent year (2009) because I was unemployed while attending full time courses in college. Therefore, should I still check that box?

2003 - met online

12-09-2010 - met for the first time

12-11-2010 - engaged

06-07-2011 - married

09-27-2011 - I-130 sent

09-29-2011 - NOA1

04-04-2012 - I-130 approved

05-14-2012 - NVC Case number received

06-26-2012 - Case completed

08-02-2012 - VISA APPROVED :)

Tell the truth. If you want to include two tax returns, hand write in the section for 2009. "Not required to file - low income", then scratch out three and write 2 in the statement following the second box.

This is wrong. When you send all three returns you check only the bottom box. The top box's question contains the word "only". To check it would be inaccurate.

Please allow me to gently remind you that questions about the I-864 are quite technical. If you are not fully confident you understand both the question and the answer and are even more confident you are technically correct in your answer, it's best you wait and read the answers from people who are confident of both. It avoids confusion and misinformation like the examples in your most recent two posts in this thread.

Interesting. They have it worded very strangely then. If you only check the second optional box, then you are never checking off to state you filed your taxes for all of the last 3 years. I guess they just assume you did because you are sending in the other 2 previous years as well. The wording needs work I think, but that is true about a lot of government forms.

And yes, if sending in complex joint tax returns, it is best to send in complete copies of everything you sent the IRS when filing. Will not forget that from now on.
