Visa Interview Unsuccessful. Please Help

Wait a minute!!

I was told it was when you lived in a country for over 12 months....if it´s 6 months, then I am also screwed up!!! I lived in Japan for 6 months. Can someone please tell me where I have to check this info?

It's six months or more if you're currently living there...it's 12 months or more of countries you've resided in since the age of 16. It looks like they added your fiance's two six-month stints to come up with the 12 month rule.

Ironically each stint was slightly (a couple of days) shorter than 6 months. I can probably show that the total stay was less than 12 months. Unfortunately, I don't think it'll do much good.

Neither packet ever reached my fiance to this day. I think they're lost in the mail. I downloaded the packets and must have just breezed over that requirement assuming it didn't apply.

Either way a pretty horrible situation. I'm gonna have my fiance plead her case at the Japanese embassy on monday (she unfortunately has to wait out the weekend before she takes the 15 hour trek back home). Even more unfortunate is that she has to relive the ordeal to come back out to deliver the form. At least they aren't requiring her to re-interview.

The instructions are very clear about needing a police certificate for every country you've lived in for a certain amount of time.

Where are these instructions? I must have missed them. I don't think they exist in the Kiev literature. Not to mention they never sent me anything from the embassy, nor acknowledged that they received the package from the NVC. I guess the real question is, how long of a stay requires the police certificate?

What have you got to lose to show that it was not 12 months? I would be on the phone or sending an e-mail right now. (well ok it is 6PM in Kiev now so the phone is out) but I would not give up so easily. They are human and if your facts support your case.......

It's worth a shot!!!

Do you have the ability to .pdf your documents? I would assemble all of my suppoorting documents including a very polite but detailed cover letter explaining your facts and why you believe the 12 month (1 year) threshold was not met and therefore a police report was not required. I would make sure that the roadmap of facts was clear and you essentially lead them to see your conclusion. I would send this ASAP via e-mail to the Kiev consulate. They typically respond in 3-5 business days. If you feel so inclined I would follow this with a phone call on Mon or Tues.

In the meantime, I would also have your fiancee get to the Japanese consulate to understand, plead and start that process in the event your efforts are unsuccessful. Good luck and keep us posted because this will be truly good information to be known for others.

Don't put all your eggs in one basket. Work in both trying to get the requirement reversed as well as doing what you need to do to fulfill it. Then, once one venue comes through (or doesn't) you can abandon the other.

How far apart were the (less than) 6 month stints? I thought the 12 month requirement was for a continuous stay, not separate visits that do not add up to a year.

Well today was my fiance's visa interview in Kiev. Up till now everything was going incredibly smoothly. But a wrench was thrown into the mix. They turned her down for a visa because of work she did in Japan. As a result of two 6 month stints in Japan, they require a Police Certification from Japan. That's two months! Does anybody have any idea how this can be expedited? I already had everything booked and time off of work to spend with her. Any help would be very appreciated.

The stints were over a year apart.

I also went back and specifically found the form that requests the police certificate. It says you need a certificate for countries "where the applicant has resided for at least one year" To me, one year is 365 days. It sure sounds like there's something here. I appreciate the advice to send over pdf s with a cover letter as well as the advice to try the Japanese embassy route simultaneously. I will undoubtedly do both. But since my fiance is still in Kiev 'till Monday, I will do everything I can do to plead my case by phone.

I actually got the instructions from the NVC, since I am getting a CR1 visa. The consulate is getting my Netherlands police certificate for me, since I lived there for 15 months (and they don´t accept one that I get myself). I thought I had read the instructions well. I guess I have nothing to worry about then. They will only set my interview date once that document is in their hands...which hopefully will be by the end of this month!

Good Luck.... and I think it goes without saying that at all times in dealing with the people at the consulate either on the phone, in person or via e-mail is to be professional and to keep your "cool". I know on many occasions I have wanted to simply come through the phone and grab the person on the other end by the collar and shout at them "Idiot! Don't you understand what I am telling you!"... (generally speaking of course and not with the Kiev consulate in particular)
