Concurrent Filling - Filing I 765 separately

Hi all,

Happy mother's day!

After I talked to a lawyer who quoted me a little less than $6000 to file AOS,

I decided to do it by myself and I've got tons of help from this forum.

I deeply appreciate your help and support. Without VJ, I probably went ahead and spent 6k not knowing how easy it was.

I got NOA and receipt for I130 and I485 in mail yesterday. Yay! Thanks again, VJ folks.

Since I am on H1B, I didn't even bother to file I765 but things have been changed and now I need to file I765 separately.

This is information I have.

I-765 Application For Employment Document

• 2 passport photos of beneficiary (attached with a paper clip to Form I-765 and signed)

• Copy of passport page with nonimmigrant visa

• Copy of NOA

Is there anything that I need to add to this?

Hey, congrats on the application! I also received my NOA's in the mail yesterday.

I think you have everything you need for your application. If it were me I might include a short letter explaining that you already have a pending AOS. It's certainly not necessary though, and I'm sure they would figure it out based on the NOA copy. Good luck!

From the I-485 instructions:

"Note: Effective July 30th, 2007, if you file Form I-485, no additional fee is required to also file an application for employment authorization on Form I-765, Application for Employment Document, and/or advance parole on Form I-131, Application for Travel Document. You may file these forms together. If you choose to file Form I-765 and/or Form I-131 separately after the effective date, you must also submit a copy of your Form I-797C, Notice of Action, receipt as evidence of the filing of Form I-485".

So no, you don't have to pay the fee, just attach a copy of the receipt for your I-485 and you should be good.
