Hello everyone!

Im in Texas, my fiance is from Moscow, Russia. I recieved the first NOA dated February 2, 2012. Im patiently waiting for approval. My fiance has been in US twice. She was in US in January, whoever due to her father passing away, she had to leave to Moscow in early January.

The fact that she was here twice (we even have an unsigned marraige certificate) will help us on the approval process?

Also, she is ffom Russia, what are the approval speeds for fiance from Russia?

Greatly appriciate any comment or response

Her being here before has no affect on the fincee visa at all. Petitions are processed the same regardless of country of origin. The time for interviews varies by the consulate you use (Moscow in your case)

Check the regional RUB forum for more details. Moscow has recently changed some interview procedures as regards US citizens so it helps to keep up on that stuff. Go to the lower part of the fourms page and find the "Russia, Ukraine, Belarus" subforum and check it out!

What is an "unsigned marriage certificate". If you are married, you are no longer eligible for the K-1.

I-129F is a petition for fiancee visa. If they have a reason to believe that you are not legally single and are already married, they could deny your petition.

Approval time varies between 4-6 months.

It's pretty funny 95% of all people who get into trouble with this process are those who use attorney/lawyers.

Oh god, I will call the attorney now! This is bad. He said it is a good proof that we have intentions to get married. This guy has collected $500 and will collect $1500 upon approval of the I129f.

Does this mean that I have a high chance of getting denied??

I concur, why would you get a marriage license that you will not use? That could red-flag them that you plan to marry before the K1 petition is approved. I am not sure that was a smart move.

After your NOA1, it is a 5-6 month wait just for the NOA2, that wait has nothing to do with the country of your fiance, it depends on the processing center and the amount of petitions they are getting through a day. They process them in order received. Then your interview depends of how long it takes for the embassy to get the approval info from USCIS and so worth. You are looking at on average 7-8 months, if not more, from time of filing until you get your interview.

This is why VJ suggests you do not use an attorney.... I would be moderately if not more concerned about this. Think about it, if they review your file, see a marriage license that will expire in 30 days, with your names on it... what would you think if you were reviewing that file? I would think that you are getting married in the next 30 days, that you don't understand what a K1 visa is and I would likely deny you and tell you to file for the correct visa. Not trying to scare you, but this could be a big problem for you.

She left the the US on January 4th, a day after I got the marriage certificate since her father passed away in Moscow. (she was here in Houston for with her father's work visa, she had a one year visa, she was here also 4 years ago with the same visa...)

Her father went to Moscow for the new year's holidays and passed away before making it back to US. She went to Moscow to attend the funeral, but since her father passed away, her visa expires... and since the marriage certificate was not valid, we applied for K1.

Take a deep breath, this site is here for support and advice. You should fill in/ create a timeline. It would help others to be able to better answer you.

Was the marriage cert. already expired by the time you sent in your I-129F packet?

Unfortunately, the status of your case is up to the USCIS reviewer who has your file at this point... You could get an RFE (request for evidence) or they could deny your visa if they think you are already married. No one can tell you for sure.

But the adjudicator who will review your file won't know all of that backstory when reviewing the contents of your file. They'll see your I-129F fiancé(e) petition, flip through and see a marriage certificate included as well and make a conclusion that you may already be married, which makes you ineligible for filing the I-129F.

At this point, you can wait to see what happens, but also have a plan b in the event your petition is returned or denied. Plan b would include looking into the CR-1/IR-1 process (go here to read up on it), where you would marry and then file to have her join you in the U.S.
