see, VisaJourney.com is a DIY web portal for immigration matters , immigrating INTO the USA.

DIY is important.

To be with a lawyer is outside the scope of DIY. Sure, you can utilize this portal to learn more, and start vetting yer attorney's actions.

If I were in your shoes, I'd submit an invoice back to him/her for a partial refund for erroneously filing the I-129F. After a while, when he doesn't pay it, can take him to small claims court and sue for the judgement against it. But that's just me. I've a penchant for being litigious when current process isn't followed properly, or at all.

Tromping/stomping immigration attornies who refuse to 'keep current' with the process is a good hobby to have, yes?

I know, I know, you (and I) just want your wife here - that's the entire point... But when this silliness pops up with an attorney, I get incensed about incompetence and ineptitude. Perhaps I'm just constipated?

Regardless, your lawyer has done stuff to lengthen the time the casefiles (now two of them) will be at USCIS.

I-129f is not officially closed it get closed only and only if I-130 gets approved otherwise it will not affect your petition.

I dont know about visa journey but i suggest everyone to read the gov website to get clear about this confusion

I am sorry, but you slowed down your case by filing the I129F. Your I130 was taken out of its place in line, married up with the I129F and put at the back of the line, so look at 5 - 6 months from the date you filed the I129F

My friend took the same route as your petition and she haven't received her NOA2 yet, mind you her petition is on its 7th month this May. Be patient and just prepare for your other documents that will be asked from you. Good luck

and you've a snowball's chance in h3ll of that not happening. USCIS is really 'that' efficient.

Look - everyone argues with me, those folk who DID file for both petitions.

At some point, the inevitable happens - USCIS puts both casefiles together, and the adjudicator reviews both together. IF there are not any gross errors with the paperwork, BOTH are approved same day, and BOTH are sent to NVC.

I challenge you to find (in the K-3 forum or the timelines section here) more than 5 'K-3' filers that actually went all the way, with a K-3 interview at the IV unit, over the last 10 months.

OTOH, I truly understand yer pain. USCIS staff refuse to acknowledge that NVC administratively closes the I-129F 'in the fashion' that you've read about. USCIS won't tell you. It's a non-conversation... At some point, you'll come to the realization that I was right, and you'll learn to jump on the IR-1/CR-1 visa path, and do document intake at NVC. It's really not that painful, I swear.

Now, what is painful (note this for future reference) is the hogwash and suffering that the VFS office makes Indian Petitioners and Beneficiaries go through, prior to interview day. IMO, that's more damaging than any of this 'case closure' stuff at NVC. VFS staff are fools... well, I'd call them moronic idiots as well, but I'm approaching an oxymoronic state of being in saying that.

ps - why'd you change yer visa type to K-1 ??

My Case is Approved by USCIS on May 25th 2012.

But its been more than a month we did not receive anything from NVC and our case is also not assigned.

Can anyone please tell me how much time NVC takes to assign the case number.

I got interviewed on 18th of sept 2012 for my visa and my wife was also there with me.

But they did not gave me the visa as my wife is elder to me so they took us to the different room and they took our interview and by the end of the interview they said that my case seems to be fine but they will send their feedback to the senior officer and they will contact me.

NOW, the issue is they did not give any letter to me ie 221 g form.

and they simply return my passport to me and i am concerned that why did not they telll that my case is in AP or they simply refused me for the visa ...

me and my wife faced a lots of ups and downs in this one year and we were waiting for this moment but now again we are waiting but earlier we can check on the website and we know the approximate time but now we dont know how much time they take for the inquiry and where we can see our case status.

we got depressed .....
