Do I need to send a certified copy of a divorce decree with my petition? I had ordered one, but it took so long to arrive that I just sent a copy my lawyer had given me. I know I need a certified one for the interview, but I had not come across info on needing one for the petition. Now after reading several threads, I'm worried although I know it's just crying over spilled milk. Will I get an RFE for this?

3/22/2012: Sent I-129F from Spain to Dallas Lockbox

3/29/2012: Packet received at CSC

4/2/2012: Touched

4/3/2012: Received Email notification of Receipt w/ case number

4/3/2012: Check cashed

4/13/2012: Received NOA1 hardcopy in Spain

7/19/2012: NOA2 approval (email and text notifications)

7/25/2012: NOA2 Hardcopy received

7/27/2012: NVC case number received

7/30/2012: NVC sent packet to US Embassy in Madrid

8/16/2012: Received packet from Embassy

8/23/2012: Received appointment letter from Embassy

8/28/2012: Interview and Approved!

8/31/2012: K1 visa received!

A copy with the petition. Take a certified copy to your interview. You were correct :)

You may get an RFE.

You should get the proper documentation ready for a quick turnaround on the potential RFE, and avoid preventable delays in petition processing. Besides, you will need the certified copy later on in your immigration journey. :unsure:

You need to send a copy of the certified divorce record, not the divorce agreement. the copy would state when the divorce was "final" or "absolute" ie, after waiting period, if there is one for your state.

I sent only a copy of the divorce decree and had no issues with USCIS approving my I-129F. Manila embassy did not ask to see a copy of the divorce decree being the whole I-129F packet is forwarded to them from USCIS via NVC.

This is from the step by step K-1 Guide:

Copy of final Divorce Decree(s) or Certificate(s) for the US Citizen and/or foreign fiance(e) if either has been previously married. If the previous marriage of the US Citizen and/or foreign fiance(e) ended due to the death of their spouse then include a Copy of Death Certificate(s) documenting that fact.

i sent a copy with our K-1 petition and I sent a certified copy to my then fiance to present at the interview, and yes they ask for it. I see no reason you would get an RFE for a copy of the divorce degree since thats what the guide says you should include.

Thanks for the responses! I guess it depends on the adjudicator, but yes, there is not information indicating a certified copy of the decree on the I-129F/K1 application instructions. I'm keeping my fingers crossed and ordering another certified copy in case I have to send it for a possible RFE.

Thanks for the responses! I guess it depends on the adjudicator, but yes, there is not information indicating a certified copy of the decree on the I-129F/K1 application instructions. I'm keeping my fingers crossed and ordering another certified copy in case I have to send it for a possible RFE.

Did the NVC send your case to the embassy yet?

When the NVC gives you a date they have sent your case to the embassy you can track it.
