Is there a expiration date for applying for AOS?

Timeline

My husband's K1 visa expires on 10/19.

We got married on 8/25.

We are still waiting for our certified marriage certificates to arrive via USPS.

This is causing a delay in our applying for his AOS.

Is there an expiration date for applying for AOS?

This is driving me insane and giving me the worst ever anxiety!

Any and all info would be greatly apprciated.

Please help!

As long as you got married within 90 days of entering the US on your K1 visa then you are fine..... Is there no way you can collect your marriage certificate yourself rather than waiting for it to be mailed?

You have been waiting a long time for it.... we had ours withing 3 days...

Are you talking about the marriage certificate or the certified copy of your marriage certificate?

We got our marriage certificate the same day and we could pick up the certified copy 3 days later? Maybe you should give them a call to check why it is taking so long :huh:

But like Kezzie said.... don't worry about your AOS application, you'll be fine :)

Hi- I've also been waiting on the certified copy of our marriage cerificate to file for AOS/EAD. It's only been a week since I mailed the request, but I wonder when I should start worrying...

Has anyone gotten married in Vegas? How long did it take to receive your certified copies from the Clark County Office? The certificate we got that day is only a "souvenir", not the real thing until it's been recorded.

The expiry date on your K1 visa only applies if you haven't used it yet, or have not entered the USA, meaning you have 6 months from the time you get the visa to leave your country and come to the USA. The only timeline on the visa once you are in the USA is the 90 days to get married. Technically you should file for AOS in that 90 days but it seems that they aren't too strict on that, some people have waited much much longer than you to file AOS and had no problem, they understand that other reasons get in the way (money, waiting for forms, etc).

Timeline

There is no expiration to file AOS.

Allthough, the immigrant will be "Out of Status" once the I-94 expires, depending upon what state you live in, you may of may not be able to get a state ID or Drivers License.

So, I would recoment you file the I-485 and associated forms right after you get your certified copy of the Marriage Cert.

In LA county it took 4 weeks for us to get ours.

According to our lawyer, there is an expiration date for applying AOS--You should apply for your AOS

before your second anniversary, which means you have two years after you got married.

We got married last Sep. and we are sending our AOS this week.

We are in TX by the way, things might be different in LA? ?
