we already got our NOA2 ON 16 April 2012 :) but after we thought we had joint sponsor !!And now they changed their minds after reading the scary i-864 instr :( ..so now we are trying our best to find some solution .

for more background about our case and my wife income!

Her income from her 2 jobs dose not meet the i-864P for 3

Has no assets to add either only one car! no significant savings either !

I own a house here in morocco.

She has a good working history and always was paying her taxes !

And she just call SSA and they told her that she Qualify for 40 Working credits!

We are 3 my wife me and 1 child !

and she dose not getting any child support.

Please we need more help and advice we already spend much time apart :(

my question here if she works for more hours at her second job then her income will be around 25,363,00

she is going to start that real soon! before sending i-864 ! i hope that can works out with sending employer letter with current pay stubs to NVC and showing that at my inter view too ! what do you think ??

If the house is in your name you can use that as an asset. You would have to get an appraisal done on it, and get a payoff statement from the mortgage company. Whatever equity is left in the home is your asset. If you have any savings or other assets that can be used too.

At the Date/time you file the I-864, The verifiable income needed for a household of three at the 125% level is $23,862. (Source: 2012 Poverty Guidelines, http://www.uscis.gov...form/i-864p.pdf)

A few others on this forum have added enough hours so that they meet the I-864 Guidelines. If she is able to do that, that should be sufficient for the affidavit of support. She'd need to continue doing that until the interview and provide you with her most current paystubs showing the right amount. If her employer will write her a letter stating what hours she is expected to work and her wages, that is helpful too.

You can add your assets to that amount also, but assets only count for a third of their value toward the guidelines. So if you own a house worth $30k, it would count for $10k toward the amount. You also have to be able to prove that the amount of cash you would gain from a sale, so an appraisal is a must. You would also have to show that it's free of liens or at least that the net value of the home minus liens and mortgages is sufficient.

You should try to marshal as many assets and income as possible, since ultimate the CO will have to decide if you are likely to become a public charge, so the more the better.

Just beware that foreign real estate doesn't really count for much but if you can document the value, it DOES count for something.

We just made some math and found out that my wife gross income will be 23,871.84 for the current year ??

While the poverty guide lines for 3 is 23,862 ??

What do you think guys ?

The math is not about what it will be for the current year. Do the math for what it will be for the next twelve months from the date the I-864 is submitted based on CURRENT level of income.

Yes sure.., My wife did not file the I-864 yet ! our case still on the way to NVC and i think we still have some time to make all proofs for that and get pay stubs and letter from the employer proving all that her income for the next 12 months will be 23,871.84 ?

also if your wife can show a new job or her current job paying more in the future, ie starting a new job, you can use that income to change the math in your favor. also if you have a job now you can add that income in to the pot so to speak. it is base not on past income but on what is being made now. so any change in jobs for more income is what should be shown backed up with employment letter and so on

There is no place for or reason to mention your wife's 40 working credits. You can mention your house in Morocco if you wish to document it's value and any mortgage against it. Whether or how it will be "considered" at the interview is not going to be known to you either way.
