Hello,

I hope this finds everyone doing well. Today, I called the USCIS customer service hotline today. I do not understand why this was said, but oh well. While speaking to the USCIS agent, I told him that we have a applied and sent the all forms with a check to the Chicago Lockbox which was delivered April 05, 2012, and we have yet to receive an NOA 1 or NOA touch or anything. He said, are you the applicant or the petitioner? I told him I was the petitioner, my husband is the applicant. He said, okay what forms did you send, and I told him all the forms that I sent. And then he says: Oh, I am sorry ma'am, I can't speak with you without consent from the applicant. I said, WHAT?! I am the wife and I am petitioning him. Why can't you speak to me? He said, I have to have consent from the applicant. Call back at a later time. Just because you have not received your NOA 1 doesn't mean anything happened. However, with the consent of your husband who is the applicant, we can better trace your case. Call when you are both available.

DOES THIS MAKE ANY SENSE?

09/19/2011- We met
10/15/2011- SA proposed marriage
11/04/2011- We married in an intimate affair


03/26/2012- We mailed I-130 I-765 I-485 (SNAIL MAIL)
03/29/2012- Confirmation of delivery to the Chicago Lockbox Office

04/19/2012- Processed on April 19, 2012 AOS from F-1 Visa
04/19/2012- Checks Cashed same day
04/27/2012- NOA hardcopy received.
04/30/2012- ASC appointment letter mailed out.

05/07/2012- Received ASC Biometrics Appointment Letter
05/25/2012- Biometrics done in Greer, South Carolina

06/06/2012- Email stating that our interview notification has been mailed out for the date of July 10, 2012 in Memphis, TN. Should be received in a few days. Nothing else regarding the EAD. Still waiting.

07/03/2012- I-765-EAD card production was ordered. Allotment of 30 days before receive.
07/10/2012- Interview at the USCIS Memphis, TN office at 1.30pm. We were approved on the spot. ALHAMDULILLAAH!!! :-)
07/13/2012- Received the 'work permit' came in the mailbox.
07/18/2012- Received the greencard in the mailbox. ALHAMDULILLAAH! :-)
07/20/2012- Applied for the Social Security number.
07/24/2012- Social Security number came in the mail. ALHAMDULILLAAH!!! :-)
07/30/2012- Applied for Tennessee driver's license and received the license. ALHAMDULILLAAH!!!! :-)

05/28/2014- We mailed the I-751 Removal of Conditions

06/13/2014- Received the NOA
06/17/2014- Received letter about Biometrics. Appointment is July 1, 2014 in Greer, SC.
06/26/2014- Did the Biometrics in downtown Nashville, TN instead of Greer, SC. (due to moving from NE TN to Nashville, TN)

12/03/2014- Case was moved from Vermont to California.

02/13/2015- Letter stating they need more proof of a bona fide relationship to be due back by May 14, 2015.

03/02/2015- Sent documentation to California.

04/13/2015- Received letter of congratulations for the removal of conditions and award of the 10 year green-card coming within 60 days.

04/17/2015- The letter and 10 year green card was received. Alhamdulillaah. Our USCIS journey is over since my husband will not apply for citizenship.

You are talking to tier 1 which as far as I know is not a USCIS officer, but a call center agent that is reading from a checklist. That is why they read to you in a structred way when asking questions. If you are not happy with talking them, then ask them to escalate the call to tier 2 which is normally a USCIS officer from what I can tell. When I talked with tier 2, they did not read from a checklist, but had a normal conversation and took down information. They are the ones who can initiate a complaint or request information on your behalf and give you a reference number for your call. Try again. You as the petitioner for the AOS applying for your husband should have full rights to discuss your AOS process and should not need your spouses permission because they are not the U.S. Citizen. If I am wrong VJ members please correct me. I am not an expert, but I know during the original petitioning process for my fiancee, I have the rights to discuss my petition.

You WERE the petitioner when you applied for the k1. You already did your part and right now you are not petitioning for anything, your spouse is applying himself to adjust his status based on the marriage with you of course (and with your support as I imagine you signed the affidavit) so it's pretty much HIS case. Have him call or you both can call together to get some info in your case. Good luck!

Yes it makes sense. They will not talk to you because it is your husband's I-485, not yours. You can ask about the I-130, but since you are doing a concurrent filing, there is no news about it and there won't be until your interview. If you get your husband on the line he with them can give his consent to discuss the case with you, on a per-call basis, usually under the guise of "interpreter."

not directly relevant but you mean you filed 2 weeks ago? there was easter in between, my guess if you wait a little more it will resolve itself...?

21/2 - received NOA in mail for all 4 (130/485/765/131)

23/3 - biometrics scheduled -> did "early" walk-in on 21 March

06/4 - received email update, interview scheduled for 7th May

27/4 - received EAD

08/5 - email: approval one day after interview (7th May)

Completely untrue! As the petitioner, I have always gotten repsonses, guidance and information even from a Tier 1 person. As the petitioner, you are able to obtain all information relevant to your case. My wife was in Africa and I would've been blown away, if they fed me some nonsense that she also had to be on a the call or I needed her permission. If I remember correctly, there is somewhere on the I-130 that you mark that you will be the person of contact regarding the case, however I would need to confirm.

I would call back to speak to another representative. Write down the prompts to get directly to an agent every time and call back to obtain the information you seek. You have the right to know about your case. However, do keep in mind that asking about your NOA 1 is unimportant to those representatives. They have no information for you, so this is how they get you off the phone without saying, I don't know why....

Um, you are talking about a spousal visa, not AOS. Totally different thing. You can't compare apples and oranges.
