Your wife (assuming she is the immigrant) may chose whomever she wishes to be her agent.

Unless you have a lawyer (in which there is choice of agent form, the lawyer is automatically assigned as the agent) the immigrant may select any agent, typically this is the USC

Yes, my wife and I want to do the electronic process. The NVC received our case from the USCIS but still need to enter it in their system. Thank you.

Remember, OPT IN is a specific process, to enroll in EP.

The beneficiary must OPT IN,

making an email with:

1. proper subject line

2. properly filled out, signed, DS-3032 file attachment in PDF format

3. proper BODY of the email.

DO NOT OPT IN until the Petitioner has the AOS FEE BILL in the email inbox.

I hate to ask perhaps such simple questions. I thought when the NVC enters our case in their system that I, the USC, OPT's into the EP. Sadly, it would seem I am mistaken. I know my wife will need to sign the ds-3032 but she could send me the signed ds-3032 aand I can email it to the NVC. Thank you for any help.

centryMN, you as the petition CAN send the OPTIN email, I sent the OPTIN email and had no issues enrolling, just be sure the NVC has your (and your wife's) email address on record.

As Darnell states, do not OPTIN until you have that AOS bill in your inbox. If you OPTIN too soon, your case ends up in a no man's land that can take a few weeks to get out of. Just read the experiences of VJ members Foobaz and Palladin who can attest to what happens when you send the OPTIN email prior to receiving the AOS bill.

I will certinaly wait to OPT in until we get the bill. I I'll prepare the email to OPT in this weekend and get my wife to sign and scan the ds-3032 and send it with the proper email body and subject line. Just to confirm, I cannot be the agent? We aren't using a lawyer, so learning this process has been stressful. Thank you.

Wrong, you CAN be the agent if your wife so desires.

Can this form be emailed???? They don't need the original with the signature of the beneficiary in ink?
