I am not sure if anyone has the answer, but I thought I would ask.

I married a man from MX in 2006. Filed I-130 in 2007. Found out that he had another family, was EWI and just wanted papers. We have been separated for almost 18 months now and I am just now filing for divorce because I could not pay for it and he was not willing to pay. NVC terminated our case last month for inactivity. I am filing for divorce this week.

I am seeing someone that is from England. We want to get married and live here in the US. He comes to visit and sees my family, but we want more now.

So my question - My divorce will be final in June and I plan to marry my fiance in August. Am I going to have problems with the papers? He is not EWI or have anything that would keep him from getting papers, but I am worried about me. I didn't marry my last husband just to give him papers and I hope they see that since I did not complete the process.

NVC terminated the case: Thats mean he didn't ever get his CR1/IR1 Visa. All right

You may not have problem as long as you give the true reasons of the past situation. That is it! It is all right if you get divorced in June and then get married in August. That is all right.

Make sure new hubby knows all about the old one, because he will be asked about it at interview, but considering the length of time since the first marriage and the fact that the ex didn't get a visa, I think you'll be fine.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

That is correct. I wasn't going to get someone a visa who was using me so I let the case be terminated.

Make sure new hubby knows all about the old one, because he will be asked about it at interview, but considering the length of time since the first marriage and the fact that the ex didn't get a visa, I think you'll be fine.

when you submit the I-130, include the prior case info and some verbiage about why you divorced him. Saves a ton of silliness later on,

as

the USCIS adjudicator will see this info, and IF your I-130 petition is approved (lets say it is, for the nonce)

then the Consular Officer at the Immigrant Visa Unit in London cannot deny his visa application based on the prior silliness with the prior man, as USCIS adjudicator already approved the petition based on what was in the casefile.

Thank you for the information. If those are your daughters they are very cute. I am part Chinese even though most people can't see it :D

ah - those are 'the twins'.. My wife and I are trying for twins, and this image reminds me, all the time ..

The verbiage translated, roughly - 'She stole my boyfriend!'
