I was online one day and she contacted me and we spoke briefly a couple of times and then we went to Yahoo Messenger and that was all for us on that site . You will have to enter this information into your i129 application. From what i read here, generally people in this situation are later asked for more information like police reports and court documents.

It's not the class/type of crime, but whether it is a crime that involved 'moral turpitude', I believe?

See here: http://www.state.gov...ation/86942.pdf taken from the DoS's Foreign Affairs Manual.

For Immigration purposes: Moral Turpitude Offenses apply to the Alien and not the USC. Thats a different Boat. Notice the word "Alien" used in the above link. Any acts of the USC in Violation of the Law are considered Misdemeanor/Felony but also it is A Violation of Moral Tupitude but is Not Classified that way for USCIS.

USCIS will ask for other documents that will pertain to the USC's Conviction.

It really would matter what the Felony was in the case of filing. Be prepared to have Court Records, Rehabilitation, ETC.

Do not Attempt to File your 129-F without these Documents/Certified.

If the OP would come forward and State the Felony then he/she could get better advice and see if a Waivor might be a good choice.

Thanks for the correction. An important one too! I missed the part where the OP stated he was the petitioner, d'oh!

when you fill out your 129f, they ask if you have ever been convicted of the following crimes, if you have not ever been convicted of the crimes they list, then your fine. If you have been convicted of any of the crimes they list as the other OP said you will need more information. Good Luck

Thanks Everyone ...SOrry ..I have been really busy . OK ..here is the deal ...On January 03, 1991 I was arrested at my home in possession of 25 pounds of marijuana and LESS than 4 ounces of cocaine and I also OWNED guns . I was convicted and sentenced on all 3 counts on April 10, 1991 . I did FINALLY win my case on the gun charge about 6 months before I was to be released and I was released 6 months early . I was a Nobody that came from nowhere ...a simple cut and dry case that involved only me and was raped on the gun charge for a gun collection that was displayed on my fireplace mantel In My Bedroom . Thanks Everyone . PS .... I do still have all of my paperwork concerning all of that . Is copies of that paperwork good enough as proof of what hadd happened and doing my time " Squeeky Clean ", doing the Supervised Release with No Problems and even getting off Supervised Release a little early ? Thanks ...Terry

You need to read that question about being convicted. If your situation applies, then you will need a certified copy of the police record and the court record with the disposition. I had a domestic from 99 and got an rfe even though I attached a letter admitting fault and that I could not get the records because it was too long ago. I ended up getting a letter from the police clerk and my file from the court which was marked destroyed.
