I am working in China as a foreign expat. I went and got married to my US citizen wife last year in the US and we both moved to China. I declared at the port of entry that I was going to get married the following week and come back out (no intent to immigrate otherwise I would have applied for K1). I was allowed entry on B2 visa and indeed after our wedding (both civil and Chruch) I flew out to come back to my job in China and my wife joined me a few weeks later. Our original plan was to spend a few more years in China. Our company is in a small Chinese town. Several months passed and my wife couldn't find a job in here, so she was teribly bored and the language barrier didn't improve as fast as we had thought so life became really hard for her and our relationship became very stressful. Recently I have consented to her idea of us moving to the States instead and we have filed the I-130. I am in China and waiting and my wife is back in the States. She travel to and fro every once in a while. I'm just wondering how long this is going to take and what are the complications. Also my B1/B2 visa is still valid would I be able to visit here without problems?

Return to China: 5/14/11

Filed I-130 and received : 12/1/11 and 12/5/11

Yes, you can still visit with I-130 pending. Bring strong ties to China, and a copy of your first notice about the I-130 in case they ask. The whole spousal visa process takes 8-10 months.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Since yer not Chinese and already hold a B2 visa - it is possible that you can come back to USA for any visits.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
