hi , is that true if the relatives or beneficiary is working abroad or outside his designated country .and they got married in the beneficiary country .

they should file a cr1 in beneficiary place where there is us embassy ? is the processing of visa will be in be in the beneficiary place even the interviews?or.

What I believe you are referring to is DCF (Direct Consular Filing) and while this is possible, I believe it only applies when both the beneficiary *and* petitioner reside within the foreign country. If you just visited to get married and will return home, then DCF does not apply to you, you will file the I-130 to the correct address stated in the instructions to the Form.

iam currently working here in bahrain (beneficiary)and my husband is in the us (usc) .

we will gonna file i-130 , but my question is. i heard from friend that my interview will be in my country .how about the processing? they will gonna transfer my case to my country?

in i130 my adress is my current address now were i am working for almost 6 yrs now.

If the U.S. Embassy in Bahrain permits DCF then the entire process will take place within the country you currently reside. You will submit the I-130 to the U.S. Embassy in Bahrain and the processing of the application will take place at the Embassy in Bahrain with some backwards/forwards with the DHS here in the U.S.-- the interview will take place at the U.S. Embassy in Bahrain.

After the interview at the Embassy, you will hand them your passport and it will be returned to you with you CR-1 visa inside, you may then use this to enter the U.S. and you will become a PR upon entry. DCF is usually a much quicker process than the standard I-130 petition.

The USC is not in Bahrain, so DCF is out of the question. OP - the interview will be in Bahrain. What is your country of origin?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Even if your country accepted DCF, you would not be eligible.

You will know where your interview will be when your NVC case number is assigned to you. You'll know because the 3-letter US embassy code will appear at the start of the case number.

I know the K3 visa requires the applicant to apply where the marriage took place. It's also from where the visa must be issued. I don't know of a requirement for the IR-1/CR-1 visa that says it must be always held at the applicant's country of birth.

If you are an American citizen you have two ways to bring your foreign spouse (husband or wife) to the United States to live. They are

Immigrant visa for a Spouse of a U.S. Citizen (IR1 or CR1) - An immigrant Petition for Alien Relative, Form I-130 is required.

Nonimmigrant visa for spouse (K-3) - It is important to note that application for the nonimmigrant visa for spouse (K-3) who married a U.S. citizen must be filed and the visa must be issued in the country where the marriage took place. After the visa process has been completed, and the visa is issued, the spouse can travel to the United States to wait for the processing of the immigrant visa case. Two petitions are required:

Petition for Alien Relative, Form 1-130; and

Petition for Alien Fiancé(e), Form I-129F

OP, you will be interviewing in Bahrain as long as you are still residing and working there when your interview takes place. When your husband fills out the I-130, he will write your address in Bahrain.
