Some of you know or you have any idea if I could have a problem to be the sponsor of my husband ,because my mom have to my daughter included in her food stamps, and also when I go to renew my health insurance and my daughter too, I try to make less in that month, so we able to have health insurance which would cover all medical expenses, either in appointments or medicines for my daughter because she has deficient of cartinite and she takes medicine daily .

I have my daughter included in my taxes, she is my depend.

My mom's had me and her in her food stamps when I didn't work years ago, then when I started to work she only took me out to me of her food stamps but my daughter stayed.

You think that I might have problems if I could to be the sponsor of my husband in my AOS. Or this is not related at all with my AOS.

Thank your answers and I hope that you have understood what I meant.

That is not going to look good at all. Why is your mom still claiming your daughter as a dependent (for food stamps) when YOU claim her as your own dependent on your taxes? It's going to raise (fraud) red flags. Plus, they may ask, if you guys are not making enough income to supplement yourselves, why add another person who (most likely) would be a public charge? You may need a joint sponsor for your husband. That situation in my opinion has to be cleaned up before going through the process.

You are the primary sponsor for your husband no matter what. When he files for AOS, you will need to fill out an I-864 affidavit of support. If you do not make enough for your household size, then you will need to find a co-sponsor that does.

You are the primary sponsor for your husband no matter what. When he files for AOS, you will need to fill out an I-864 affidavit of support. If you do not make enough for your household size, then you will need to find a co-sponsor that does.

sorry I respond this for her, she is my sister ( Newbies J & J) this is what she replied:

When I started the paperwork for the visa k-1 of my husband, in 2011 I need a co-sponsor because for 3 people the line of poverty was $ 23.162 and I just reached $20.989 in 2010 of , but this year my taxes in 2011 I reached 25 thousand, now only I have a job, because in January closed a factory and my work earned $270.00 a week by check and I have $ 400.00 per month that the father of my daughter sends me to the bank, other than I have in my savings account $ 9,000 saved, and sometimes I put cash for payments house cleaning or babysitting.

That's why you asked if despite of that you believe that I have problems because my daughter is my dependent, my mother has her in her food stamps, some people told me that had nothing to do with the processing of the papers, but I'm really in doubt.

Please help me with that, what can I do. Besides the co-sponsor who previously helped us with the processing of the papers ,he can not help us again.

Generally, Food stamps does not affect filing. The only way your mom can have your daughter on the food stamps application is as a household member or if she is responsible for her. In any case, food stamps does not affect AOS. That is not considered requirement as ward of the state. What your mom does has no bearing on your position as sponsor.

You may not have problems with immigration but eventually your mother could face fraud charges regarding the Food Stamps: IPV (intentional program violation). I work for Legal Aid and I handle the Food Stamps and Medicaid cases. If your mother faces and IPV, she (and your minor daughter) will be responsible to pay back any benefits that were fraudulently given to them. Don't worry about the criminal charges since they are rarely pursue. But usually, local FS agencies eventually find out.

It's very simple: everything and anything is possible. The irony is that you worry, therefore you don't need responses to steer you clear of something obviously wrong, that your well aware of a type of fraud that can lead to a denial or penalty on a family member. Rectify the matter, ASAP and commence your life with your spouse; the earlier the better :)

Sorry for being straight forward, but my response is a bucket of cold water; in comparison to "possibly" many years of misery..

Thanks at all for your answer and now I understand everything very clear, maybe subconsciously my mother and I did not take to much importance that this would bring us problems one day because my daughter and I live with my mom and when I began work as well, obviously my mother had to remove me of her food stamps it, but in that time we thought that didn´t necessary to remove my daughter also of food stamps as we had continued to live with my mother... It was as a way to help each other.

But despite all this, you believe that there will be no problem for me to be the sponsor of my husband in our adjustment of status right? With all that I mentioned to you earlier.

The food stamps for your daughter are not the issue for AOS and the affidavit of support. If you make 125% or more for your household size, which seems to be 3? You, your daughter and husband, then you are fine. If you do not make enough, then you need to find a co-sponsor that does.
