Hi everybody..

I started my K1 Visa journey back in APR 2011, I went through the process successfully and married my now husband in November 2011. Soon after we filed for AOS and have been waiting patiently to hear back about the next steps. After being here for a little while, having had an emergency hospital stay, after finding out my mother back in Australia is ill and a general concern for my mental well being my husband and I have decided that we want to move back to Australia. Can anyone give me advice about how I would go about seeking a pardon for my AOS. I do not want to have a ban placed on me because I "abandoned" my applications because I know while we won't want to live here in the USA we will want to visit the various family members and friends we have here.

I don't know if this is even possible, I have searched the forums and come up with nothing. But if anyone can shed some light about what could be done and how I would go about it. I would greatly appreciate the help.

You don't need a pardon. You can write a letter withdrawing the application with an explanation if you want. You won't be flagged. Your ESTA might not be approved for a while, so you might need to get a B2 for visits. Good luck.

Harpa is right, you can just write to withdraw. However given that it will affect your visa and VWP (immigrant intent issues) personally I would wait until you get the GC (I don't know when you filed AOS as your timeline isn't there). Once you get your GC you can just hand it in at the embassy in Australia. I don't know how long you've been planning the move and whether you're just ready to go now but if you've still got time before you would I'd give it a chance. It will look a lot better for you visa wise later.
