ok, so, we did a request for expedite over the phone, faxed the documents and a few days later we recieved the denial email.

my wife contacted the senators office, because we felt our expedite request was valid, the senators office contacted the uscic, and we found out that they " never recieved the supporting documentation," the senators office asked us to fax them what we sent to the usics, and they would send it again and ask them for it to be reviewed again,

we just recieved this email from the senators office:

Please see the response below from the USCIS regarding the expedite request for your husband’s visa. Thank you!

Good afternoon Laura,

Your request to expedite the adjudication of this I130 petition was approved and the case has been assigned to an officer for adjudication. Your constituent should receive a notice of action* within 7-10 days.

Approved I-130 petitions will be sent via UPS delivery to the U.S. Department of State at the National Visa Center (NVC). Your constituent should also notify NVC if there is a change in their personal situation or to provide a change of address for the petitioner and/or the beneficiary.

*A notice of action may be in a form of Approval Notice, Denial Notice, Transfer Notice, Request for Evidence, Notice of Intent to Deny or Notice of Intent to Revoke.

2012-01-11 "touched"

2012-01-12 expedite request on medical grounds submited .. cross fingers

2012-01-20 expedite request denied >.<

2012-01-21 Contacted US senator

2012-01-27 recieved email from senator stating they will submit expedite request again on our behalf and request extra review

2012-02-10 recieved email from senator with reply from uscis granting expedite!

2012-02-11 NOA2

2012-02-13 NVC recieved case

2012-02-22 Case number assigned ,DS-3032 submitted

2012-02-24 DS-3032 accepted, Submited expedite request, forwarded to embassy for review

2012-02-28 expedite approved by embassy , SIF

2012-02-29 Case complete, shipped to consulate, according to AVR

2012-03-03 consulate recieve file and log into system

2012-03-07 Mailed off DS-230 & DS-2001 & had medical

2012-03-19 Interview APPROVED!!!

2012-03-23 Visa in hand

2012-04-12 POE chicago

thank you, apaprently we recieved the email from the senators office this morning , i just logged on to the uscis website and it says that the petition has been approved and is in post decision activity, altho i didnt recieve my noa2 email, but yay! hopefully ill beb ack with the wife and kids before the baby is due,
