Thank you! One thing I forgot to mention is that his work permit expired in November and is currently in process of "hopefully" getting extended. Should that have any effect? Will they ask for current working papers if he goes there to do his visa interview? My number one fear is that if his work permit does not get the extension, and he tries to complete the visa process from London, that they will accuse him of trying to overstay his welcome there, and effectively deny his visa for the US. I'm not sure if this is a valid fear, or if I am overthinking this...

London embassy can only process his case if he is residing in the UK legally at the time of the interview. They will ask for proof of his legal status. So if his work permit is not renewed, he'll have to go back and interview in Nigeria.

i think on da safe bet, to avoid delays at that stage of ur petition, u should do interview at Lagos.. i think interview is usually where the beneficiary is a permanent resident. if he's needing visa's to hang around, ur streching it and wat ur not sayin is da concern if he leaves UK he mite not be able to return.. well, dats ur call.. but petition transfers from one consulate to anoda adds almost two mnths.

I believe that the OP said his papers expired in November meaning they are already expired....I f I were you I would wait for the outcome to see if he is granted the extension if he is then go through Londond to process your paperwork...if it is not extended then he will have to return to Naija to finish the process and make sure he doesnt over stay in London.....Good luck :thumbs:

does the expired work permit mean he is in UK illegally now?

if it does, he can't process in UK..

i have seen people with transfer cases but not all is additional 2 months

Pat what happens if he didn't get the visa extension and does his overstay in another country affects his fiancée visa?i believe the situation where you overstay count against you is when you do it in U.S and not other country.

Thanks everyone for all of the advice! I guess technically he's "illegally" there, but his lawyer is working on his extension. I don't know the rules regarding how soon after your permit expires that you have to leave the country. However, I agree with you all that to be on the safe side, I will advise him to just go back to Nigeria so we can avoid any headaches and delays!

My fiance has been living and working in London for the past two years. Will he have to return to Nigeria to process his paperwork, or can everything be done in London? Any help or insight would be appreciated!

Can they Process his Visa if he is living or working Legally in the UK at the time of attending the interview? Absolutely...he will however be denied if he is out of status at the time of going for the interview.

My fiancé is currently living in uk.his uk visa will expire in April 2012.his visa was refused last week because my lawyer filled out a wrong affidavit of support form.so the consulate handed him a 221g and asked for the correct from.we will send the correct from this week.now my question is if we do not hear any thing back from the embassy before April can we request his passport back so he can go back home????is there anyhow we can transfer this pettition from London us embassy to Bangladesh us embassy??
