Will our K1 petition be denied if we go out and get a marriage license?

We have a pending K1 petition and I was wondering if we are going to get denied if we go out and get a marriage license in the Philippines. No marriage took place. Lets just say the couple got really impatient and got frustrated so they said, the hell with it went through the motions but didn't actually get married. I know for me I'd have to get a legal capacity so I'm gonna get flagged at the embassy as I'm sure they maintain some kind of a record.

Your K-1 would become void and you would have to re-apply for a IR-1/CR-1 visa.

So wait, getting a marriage license voids a K1 petition even if NO MARRIAGE took place? Getting a marriage license does not make a couple legally married, correct? Therefore if no marriage took place, we're still free to marry, is that not correct?

My apologies if I was unclear... There is a marriage license but NO WEDDING/MARRIAGE, decided to wait after all. It would be like calling Domino's pizza ordering 2 large pepperonis but never picked it up so no pizza was consumed! Sorry that's the best I could come up with. :rofl: :rofl: :rofl:

This may have been a costly mistake... was going to go ahead and get married then file a CR-1 but decided to wait it out for the K1. I'm confused as to why getting a marriage license is being perceived as being married. One could go as far as the altar on their wedding day and decide not to go on with it and turn back around. That does not make the couple married even though there's a marriage license and some 200 family and friends waiting to witness the ceremony. Is my logic flawed? I'm just trying to understand... or is this one of those situations that's gonna a lot of fun explaining to the consular officer? By fun I meant PITA.

Getting a marriage license does not make you married, you are correct. If the consulate has some record of this and if they even believe you have done something to void the K-1 they will not issue a K-1 visa. It would be your obligation to rpove you did NOT get married. You are not entitled to a visa, they CAN deny you and they WILL deny you if they think there is something fraudulent about your case. It is not a court, they do not have to have evidence. The CO makes that decision and you deal with it.

Be assured that getting married would not be advisable for impatient people as it would ADD many months to your wait time.

The OP clarified his questions and I understand now. Nothing will happen by getting the marriage license. As long as the marriage license is not register with in the country. Nothing will happen.

Why even entertain that thought when you have submitted a K-1 (Fiance) petition...!! The whole purpose is to immigrate to the petitioner's country and get married. If you do change your mind mid process and follow through with the complete marriage and register the marriage certificate. Your K-1 visa will be void money submitted lost. You will have to re-apply for IR-1/CR-1 visa and pay a new fee and expenses, time and effort. Plus you will need to explain if you ever applied for a visa before and why you cancel your visa.

Everybody has the right to change there mind and do as they please but the visa process is so long and delicate already why make it more complicate and waste more time then you need.

It'll be up to you to prove you aren't married if the interviewing officer suspects or questions it. If that's

the case you might end up needing a marriage license after all, and go the cr-1 route.

..If you don't pick up the pizza, the next time they might not make one for you. You pay up front with embassy pizza. :)

Dont worry youll be okey...... As long as there is no marriage took place everything is fine you can proceed with your k1application about in the interview the consul will ask for evidence that she is still single and she can simply submit CENOMAR ( certificate of no marriage ) you can get this in NSO OFFICE as a proof that she is still single

There are couples that DID NOT get a marriage license but when through the ceromony only "for the family" and the CO looked at that as being married, you applied for the license if there is record anywhere of this, you may have screwed the pooch.
