Hello to all my VJ friends,

As always I need your help to answer to this question which would help a good friend of mine.

My friend's wife entered the US with a K3 visa a couple days ago. Today, they went to the Social Security office to apply for SSN and they found out that the DOB on the visa was inaccurate. The question is what can be done to have this fixed? Do they have to act now before she is issued a conditional green card? Please help them on where to start and how this problem could be resolved? Thank you all

Its to late to fix the visa now she already used it to enter the USA. But you will need to make sure that the information on her files etc is correct.

You will need to speak to USCIS and most likely make an infopass appointment as they may not change the information over the phone.

When you file for AOS make sure everything on the papers is correct.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Its to late to fix the visa now she already used it to enter the USA. But you will need to make sure that the information on her files etc is correct.

You will need to speak to USCIS and most likely make an infopass appointment as they may not change the information over the phone.

When you file for AOS make sure everything on the papers is correct.

She was told at the POE that she will receive her conditional green in acouple weeks, so my question is, should she wait or immidiately call and make an infopass appointment? Any other suggestions?

Call them right away - if her green card comes with the wrong birthday on it you have to return the card and to get a new one with the correct information takes around 6 months.

Thank you all for your help!! I will tell her to call USCIS first thing tomorrow. If there are any other suggestions, please let me know. I appreciate everyone's thoughts and help on this.

Then this is a CR1 visa case, not K3. If the date of birth was correct on all the paperwork but not on the visa, you're probably OK. If wrong on all the paperwork, that's a different story. K3 visa holders are not entitled to SS numbers or green cards.

Firstly, if she has a K-3 visa in her passport - she is ineligble for a SSN. At a minimum, she would have to apply for a EAD, have the EAD card in hand, then go back to the SSA office and apply for a SSN.

But - let's assume for the moment that she not have a K-3 visa stamp - let's assume instead, she has an IR-1 or CR-1 visa stamp, because the USCitizen Petitioner did NVC document intake for a SPOUSAL VISA, yes?

When the name is wrong like that - 9 times out of 10 the SSA clerk will initiate a 'USCIS Verification procedure' which takes 30 to 60 days. Your friend not want this - is a waste of time. HOWEVERR - if she just came in, crossed into the USA via POE - she's not in the SAVE database system yet. Suggest they come back to SSA office 2 weeks + 1 day (15 calendar days) and try to apply again. If the SSA clerk has already initiated the USCIS verification procedure on her - then she needs to get back to the SSA office and withdraw her SS-5 application - as she really started TOO EARLY . If she lets this process take it's 'natural course' - we'll, she's botched up the works for up to 2 months - she really needs to apply at day 15. Not day 3, like she did already.

For chasing after a SSN? no. There's a way to fix name problems with SAVE database, but unless yer wife's friend verifies with the SSA clerk (face to face, at SSA office) on a SAVE LOOKUP and the RESULTS of the SAVE Lookup (not found, A# digits transposed, VISA name wrong, or actually FOUND) yer spinning yer wheels in the pursuit of a SSN for yer wife's friend.

Suggest you click the link I posted from a PC, read all there.

Calling folk (DHS,SSA, USCIS) isn't useful, yet, as she's just come across the border. I suggest you reread my post to you here, post #8, it's chock full o info, and also read (or re-read) the contents of the link that I provided.

After I posted all that stuff to you, you decided to call into USCIS and inquire . I wonder why that was? I wonder HOW you were able to talk with them about your wife's friend's casefile, as that info is purely confidential to the USCitizen Spouse and the Foreign Spouse.

But - let me digress a bit. The birthdate was wrong on the VISA stamp, yes? Or when the look up was done, the date in SAVE was not matching with the VISA STAMP?

-- If the VISA STAMP is wrong, compared to the birth certificate - I'm mostly lost - suggest to that couple that they wait until the green card arrives.

--If the VISA STAMP IS RIGHT, but the SAVE database data is wrong - then THAT can be fixed at a local CBP office.

Sorry, yer wife's friend is having this trouble, really.
