Quick Questions:

My wife came to America (with her son) in August. We got married and applied for AOS (I-485). We have not gotten a response yet, but did have the biometrics interview). Neither of them have an SS# at this time.

My questions are:

1. Do they need to have SS#'s so I may claim them as dependents on my taxes?

2. What is their current status? Conditional Resident as opposed to Permanent?

3. Once I get AOS, can I then get SS cards?

You should have gotten each of them a SS card during the 90 day period when they first arrived in the US. You can now only get them an ITIN (this is a temporary Income tax Identification number from the IRS. Visit the IRS website and see how to do this. Their current status in the US is "without status." This is because you have not successfully applied for their AOS. And, yes you can get them a SS card after the AOS application is approved and each person has their 2-year conditional green card.

Suggest you wait until they get SSNs then file the Tax Year 2011 set, even if it's past the cutoff date with the IRS.

otherwise - you COULD file a paper return NOW with 2 W-7 forms - this will get them an ITIN # [study the W-7 instructions for what to do, how to do, which IDs they need] - is nothing electronic on this except MAYBE the ACH'd refund amount - but if you not get SSNs on yer folk during that 90 day window, you prolly not have her name added to yer bank account - and the IRS will usually issue a paper check if Treasury department not validate the two names on the bank account.

Yes. Issuance date of SSN not matter - what matters is the marriage date.
