we are filing our AOS and i have a bunch of questions.

1. the I-765: is that filled out if the K-1 visa holder has a temporary EAD for 90 days? is this the form for the actual 1 year EAD? Is it possible to receive the EAD before the Approval of AOS?

Yes, you send in I-765 to get the one-year Work Authorization.

And it is always approved before the AOS, otherwise there would be no need for it, because once you have your Green Card, you are able to work and travel.

Edited to say:

You can't submit the EAD application without submitting the AOS application, though and you can't submit either of them until after you are married.

Sept. 2/08... Oath Ceremony

Sept. 5/08... Sent in Voter Registration Card

Sept. 9/08... SSA office to change status to "U.S. citizen"

Oct. 8/08... Applied in person for U.S. Passport

Oct. 22/08... U.S. Passport received

DONE!!! DONE!!! DONE!!! DONE!!!

Apr. 6/05... DS-230, Part I faxed to Vancouver Consulate

May 26/05... K-2 Interview - APPROVED!!!!

Sept. 5/05... Entered U.S.

Sept. 7/05... I-485 & I-131 sent to CLB

Feb. 22/06... AOS Interview - APPROVED!!!!! (Passport NOT stamped)

Dec. 4/07... I-751 sent to NSC

May 23/08... 10-Yr. PR Card arrives in the mail

Mar. 22/11.... N-400 sent to AZ

June 27/11..... Interview - PASSED!!!

July 12/11..... Oath Ceremony

The I-765 is good for a year. It took Claudeth about 75 days from filing ot receive hers.

Yeah the form is for a year and it's still possible to send it in despite having a 90 day working permit from POE. We had one of those, but were fine for getting a yearly one anyway until our AOS was approved.

Make sure you write in the correct eligibility category -- you are applying for EAD based on AOS, not based on K-1 visa. If you write in K-1 visa, you'll get one for only 90 days or you won't get one at all, and they're not going to refund your money.
