Hi Everyone! I'm new here ,I am a Filipina...we just got married with my American husband last Nov.2011.He asked me to review about the USCIS while he's busy working right now so I could get some info. when he apply the I-130.Then my friend just gave me this site.We are both know nothing about all of these petition matters so we are willing to know everything because we want to be each other soon! he came back in US,and we miss each other so much! I am a single parent when we got marry,he love my son too and wishing to get my son a visa also.I need some advice from all of you there.What is the first step we have to do? Which is much better K3 or IR-1/Cr-1? Which is more faster? How about my son,what kind of visa he could apply for him?Thank you so much! hoping for your immediate reply...

K-3 virtually doesn't exist and not used anymore. So since you are married go with CR-1/IR-1 visa and you child can qualify for CR-22/IR-2 visa. There is really no other route for you. Sorry to break the bad news but there is nothing fast about this process the CR-1 visa would take you about 10-12 month. While some people get it faster the 10-12 month this is what you should expect from the process.

He will need to submit an I-130

You will need to obtain certified copies of marriage from NTS.

You will also need to complete DS230 and send it to him.

You will need a police clearance from the NBI that is good for 1 year also.

I recommend getting two certified copies of each.

You will need to obtain certified birth certificates

He will also need certified birth certificates and divorce decrees

Just follow the process and look to visa journey for help.

You do not need an attorney.

Because you want to bring son to US, you will need approval of father if he is on birth certificate or was involved with raising the child.

Others can give you better info for child and what is required in the Philippines.

It is a 10 month on average process.

Sometimes the process takes longer because of the medical in Manila. They seem to fail conservatively when checking for TB. They often require aditional testing that delays you in getting the visa. You can read a lot on visa journey about that also.

I did K3 because i heard it would be faster but NO !

If i have to do it over again, I would choose CR1 just like many others have suggested me last year.
