Hi all:

My 2 year conditional GC will be expired on April 15,2012 which means I can send my I-751 package as early as Jan 15,2012.Pretty much everthing is ready EXCEPT 2011 tax return.

My hubby says it will be ready by mid Feb or latest by March,2012.

Can I send the package without the 2011 tax return ,then when it is ready, I will send it?

How important is it to include 2011 tax returns?

Or should I wait till the tax return is ready and send everything all together?

Honestly I don't know anything about roc process, but judging by how the immigration system works, I would say yes, because worst case scenario, you get an RFE and that will buy you some time

The joint tax return is just an additional piece of evidence showing that you are living a joint life. Unless it is the only piece of evidence you have, there is no reason to wait to send off your I-751 :-)

Agreed. If you have an otherwise strong packet of evidence of a bona fide marriage, no need to wait. If it will put you at ease to include it, you can wait since you'll still be within your 90 day window to send in your ROC.

Like ooMie, we just included our joint federal and state tax returns for 2010 and 2009 because we wanted to send our packet this week (mailed today) and we probably won't file our taxes for 2011 until February 2012 just to make sure we have all the tax stuff (W-2, interest income docs, etc).
