I'm in the military petitioning my fiancé and I'm curious to know whether I need to show my military contract and some kind of letter stating that I'm really in the army? Do I also need to show or provide a letter stating my salary when I can just give them my military W-2 form?? Thanks for everyone's help

Provide LES statements and W2 with your tax returns.

We sent about 8-9 LES

And tax for 3 years with W2s.

My employment doesn't guarantee hours so I'm part-time. That's the reason they won't provide me with a letter stating my salary. How can I show the consulate I'm really employed? Should I provide them paystubs? will that be enough??

I know I'll need to have a co-sponsor and I have no idea in how I can do this. I dont even know where to start. Do I need to provide the consulate my co-sponsors income tax return as well and their paystubs? Do I fill out any forms for my co-sponsor to be turned in to the consulate. My fiance's interview in on jan 11th and I'm worried. Pls help

WOW - talk about last minute...

Anyway - if your income does not qualify you then you'll need a co-sponsor BUT Manila is notorious for NOT acepting them, except on a case by case basis.

As for you - even if you'll be using a sponsor you'll need I-134 for you, tax returns with W-2's, recent pay stubs.

If you're using a co-sponsor he'll need all listed above, PLUS his income will need to be sufficient for HIS household size + your fiance.

So what is the truth then?

Are you in the military like you said or are you a part-time worker?

I can't answer the cosponsor part of your question, but as for your own income, you can *usually* use pay stubs and previous tax returns (including W-2s) without a letter. Emphasis on usually. At least this is what is stated on my fiance's "packet 3". It may vary between embassies. An increasing number of employers are reticent to provide proof of employment letters, or go cheap and use unhelpful services the WorkNumber.com, so fortunately the State Department has adapted somewhat.

If your income is irregular or close to the limit, however, I expect they will want more.

I'm in the army reserves and I also have a civilian work. I have two jobs total. Being a reservist doesn't mean I get paid a lot although I was deployed during 2009 thru 2010 and I made more than the 125% poverty income.

My co-sponsor will be my sister and she lives with me. She made over 30k this year and has a kid. Will she need a letter from her employer stating her salary? Do you think her salary this year is enough? Thanks

Your sister's salary meets the guidelines. She needs to have sufficient income for her houshold (herself and her child + your fiance). If your fiance has children that will change the number of household size your sister will need to qualify for. Since I don't know if your fiance has child(ren) here are minimum 125% income standards:

3 in household = $23,162

4 in household = $27,937

5 in household = $32,712

She will need I-134, tax returns with W-2's, letter of employment, recent pay stubs.

HOWEVER, as I stated above - the Consulate in Manila has the discretion to NOT permit a co-sponsor. I would send an email to the Consulate in advance of the interview and explain the situation.

2 weeks prior to the interview is not a good time to first be starting to prepare for a co-sponsor...

Do you have all the other items needed done? Are all the DS forms completed? Updated letters of intent to marry from both of you? Does she have her police certificate, passport, etc?

On the I-134 it specifically states in question #3

to list children accompanying or following to join...

So, for your co-sponsor, the household size will be her, her child, your fiance and your fiance's two children = 5. If your sister only makes $30,she does not qualify to be your sponsor. For the K-1 you can not combine finances to qualify for the 125% of poverty guidelines but for AOS (later on down the road), incomes can be added by more than 1 co-sponsor.

You have a serious problem. Assuming that the Consulate will accept a co-sponsor in your case, yous sister does NOT qualify. You need to:

a) Find another suitable co-ponsor right NOW

b) Hope that the Consulate will accept a co-sponsor in your case

I wish I had better news for you, but at least you still have a chance to find a qualified co-sponsor.

The "DS forms" are the documents your fiance will need for her interview... DS-230, DS-156, DS-156K and in some cases DS-160.

As far as I know the Philippines does not accept co- sponsors for K-1. I know of a couple who was approved with one because it was the petitioners father but as far as the Phils forums go people say no co-sponsors for K-1.

The embassy in Manila usually doesn't accept joint sponsors for K visas. The circumstances where they make an exception seem to be when the petitioner has a good reason for not having sufficient current income (they're a full-time student, for example), they have good potential for future earnings (they're about the graduate, for example), and the joint sponsor is a close relative of either the petitioner or the beneficiary (good chance the joint sponsor will come forward and sign an I-864 when the time comes).

If you're working a part time job because it's the best you can get then that won't look like a good reason for not having sufficient current income, nor will it help with potential for future earnings. Military personnel have a lower income standard to meet, but only if they're on active duty. A reservist who isn't on active duty will have to meet the same income threshold as everyone else - 125% of the poverty guidelines. About the only thing you have going for you is that your joint sponsor is your sister.

If you're denied for the public charge requirement then you may have to go to the Philippines and marry your fiancee. They always accept joint sponsors for spousal visas.

It would be a good thing, except her income isn't sufficient for the household size. At $30k, she comes up almost $3,000 short.

I'd say the OP has serious problems.
