We filed the AOS 2 wks before her I-94 expires, what happens now? Can she get in trouble for being here after the I-94 expires? and the AOS has not been completed?

Thank you!

No, she enters a period of authorized stay. You are okay since you have filed the AOS already. If you are concerned, carry the NOA1 with you showing that you have filed. We never did that and just waited for the green card to arrive. No problem at all.

If you're not close to boarders and when you're staying on the legal side of the law, then there's not that much of "getting into trouble" with an expired i-94. It isn't relevant for the police to ask about your immigration status unless you're arrested(as far as I know), or in a state where the cops have the authority to check it.

I carry around a copy of my passport and have done so since my POE, that's about the amount of ID I have on me at all times.

We did have a wrong sticker on the license plate(it had been renewed and we forgot to check it before putting it on) a while back and the police pulled us over. I admit it wasn't really a thrill sitting there with an expired I-94 even though I knew he wasn't going to ask for anything relating to it.

K1 process, October 2010 > POE, July 2011

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

AOS process, December 2011 > July 2012

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

From filing I-129F petition until greencard in hand: 655 days
