Hi everyone!

So it finally will be that time soon to file for my husband's permanent 10yr green card...so this is the situation that I have a Question on...for the last year my husband has worked out of state and has stayed with relatives during that one year while working...I on the otherhand stayed behind in NY because I was finishing up some classes.

I am now done with the classes. When we filed for his AOS papers, we were both in NY together. Well, with him now out of state, he doesnt have his own place (staying with relatives) because we're trying to save money. There is a review course I still need to take for the next 2 months before I can go to him...this is the exact time that coincides with the filing for the i-751...I don't know which address to officially use when filing for i-751. Should I use the one here in NY or where he is now?

Any advice would be helpful...or any website you can send me to that could help me more would be helpful as well.

When you file removal of conditions you put the address you live at on the forms.

If you move during the process you submit a change of address and call USCIS to notify them and have them update your active case.

A Green card holder is required by law to notify the USCIS of change of address within 10 days of moving.

The USC should also submit change of address forms when moving but is not required to by law.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Yes thank you I do understand that you have to file those paperwork...we did so indicating a temp address...I just want to ask which address to officially use when filing since our original address used was the NY one (the address I am right now).

Its up to you. Bear in mind he needs to do biometrics and it will be in the area of wherever the address you put on the forms is. Same for the interview (if he has one). It sounds as if it would be easier to put the address he is at now (unless he plans on moving) as he would have either 1 or 2 flights to get to you, and you would have 1 MAYBE.

The other issue though is for ROC you need to prove that you're still together. What documents do you have that prove you live together? He's living in a different state to you. I assume his drivers licence is from a different state. It looks more like a business arrangement than a relationship. I'm not trying to be rude but you should be aware of what USCIS will think. You will need a LOT of evidence to overcome the fact you live in different places. You should NOT lie and say you live together because you don't. You SHOULD however show evidence of staying in touch, flights to see each other, calls, emails, etc.

No I understand what you are saying Vanessa&Tony...it was a difficult choice for us when he took the job out of state because for one full year he was looking for a job here in NYC and that got frustrating for him and for me (since I was studying at the time and once he got the opportunity to get the work we both decided that would be the best for us to save money.

The situation where he is out of state is only temporary as I will be joining him once my review course is done...so hopefully USCIS will see that. I do have the evidence of us in a bonafide marriage...all what you mentioned in your message. And I definitely have no plans to lie to say we live in the same place. I think I will use his out of state address since that's where I will be going once my review is done. Situations are different for every couple...but I thank you for your input.
