Happy Holidays!

I am passing the time on X-mas eve by reading other people's post. I am in my 3rd month of filing my petition in VSC and hope to hear something back by Jan-Feb 2012. I was just curious if anybody that filed got denied and what where the reasons?

I typed in K1 denied in the top right search box and many came up.

Looks like at uscis they can deny for no evidence

Mostly looks like interviews get the denials. One did not fill out the form right. others did not prove real relationship

May 24, 2011 NOA1

Sept 11, 2011 NOA2-took 19 days to get case number

Sept 30, 2011 NVC number and IIN received Friday-gotta wait till Monday

Oct 13, 2011 Case Completed- 13 days from receiving case number Took 32 days from NOA2

Nov 30, 2011 Notified of Interview date

January 19, 2012 Interview- 240 days from NOA1

INTERVIEW RESULTS-APPROVED WITH 14 WEEKS AP--but he got his visa in 56 days!!!!!!

Same here, buddy.

When I joined here 3mos ago, I've only seen one VJer from PI that got denied for not not showing enough proof of a bonafide relationship, some were put on hold about the medical results, the rest are worried or have received 221g about income requirement specially for K-1 filers.

You can do a search in the threads, there are many posts with this subject. Most often, I notice that denials happen at the interview stage in high-fraud countries. Usually the reasoning is not enough evidence to prove a bona fide relationship. In comparison to the number of approvals, they're much much much smaller in percentage.

There r Just too many reasons that accounts for denial

Non Proof of Ongoing Relationship

Inability of Petitioner to show financial suppport

Unfinalised divorce from either Petitioner or Beneficiary

Wrong filing of specified docs.

Getting Married in a K-1 Process.

Lil or No knowledge of Spouse/fiancee

Large Cultural/Age diff in some consulates

Request for more evidence (not an outrite denial)

Child abuse/criminal record against the petitioner

These r just part of it and varies from each countries

I would say this is: Best Answer since the OP has already recieved the NOA1 and waiting. The Time difference between a NOA1 and NOA2 is background Checks. If they find something that they don't like you will get a RFE before issuing a NOA2.

So I say: Best Answer is Above. THAT INTERVIEW IS THE MOST IMPORTANT WHEN YOU PASS THE OTHER STAGES. (NOA1/NOA2)

USCIS does not issue K-1s, they approve petitions. There is nothing for them to "deny" They can "not approve" a petition.

The requirements for a petition approval are exceedingly easy...

1. The petitioner MUST be a US citizen, born or naturalized

2. The couple MUST have met in person at least ONE time in the previous 24 months

3. Both must be eligible to marry at the time of filing

4. Both must state they intend to marry within 90 days of the beneficiary's arrival

You must prived evidence for each of those requirements. If you do not, they will send you an RFE. You MUSt respond to the RFE with the evidence they request. If you do not your petition will not be approved.

"Evidence of relationship" is not required for a petition, though some people include it, it is NOT included for the purpose of petition approval.
